Regulations for Deer-shooting, Nelson.

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-first day of January, 1907.

Present:

THE HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

IN exercise of the powers vested in him by “The Animals Protection Act, 1880,” and the Acts amending the same (hereinafter called “the said Acts”). His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations respecting the deer-shooting season within the Nelson District, comprising the Counties of Waimea, Buller, Takaka, and Collingwood, and hereinafter called “the said district.”

REGULATIONS.

  1. Red deer stags and fallow deer bucks may be taken or killed within the said district from the 23rd day of February, 1907, to the 22nd day of April, 1907, both days inclusive.

  2. Licenses to kill such deer may be issued by the Chief Postmasters at Nelson and Westport, on payment of a license fee of £1, in the form prescribed in the Schedule hereto, and subject to the said Acts and these regulations.

  3. No licensee shall be allowed to take or kill more than six red deer stags or fallow deer bucks, and the said Chief Postmasters shall not issue more than one license to take or kill deer to the same person.

  4. No doe, hind, or fawn will be allowed to be killed on any pretext whatever; and no dogs will be allowed to accompany either the licensee or any attendant he may have with him.

  5. Nothing herein contained shall extend to authorising any person to sell any deer or portion thereof.

Conferring Jurisdiction on Native Land Court.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-first day of January, 1907.

Present:

THE HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by section fourteen of “The Native Land Court Act, 1894,” it is enacted that the Native Land Court shall, as regards all lands within the meaning of subsection ten of section fourteen aforesaid, have jurisdiction as in the said subsection mentioned: Provided that the Court shall not proceed to exercise such jurisdiction unless the Governor in Council shall by Order authorise the same to be done:

And whereas the land specified in the Schedule hereto is land in respect whereof the Court has jurisdiction as aforesaid, and it is expedient that the Court should be authorised to exercise the same:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby authorise the said Court to exercise in respect of the said land the jurisdiction conferred as aforesaid—that is to say, to determine whether or not the said land, or any part thereof, was, on the investigation of title thereto, intended by the Native Land Court, or by the nominal owner or owners of such land, to be held by such nominal owner or owners in trust for Natives not named in the title,

and to determine who are the Natives (if any) entitled beneficially to such land, and to order the inclusion of such Natives in the title, either together with or in lieu of the nominal owners or any of them, and for the purpose aforesaid to order the cancellation or amendment of any existing instrument of title, and the issue of such new Crown grants or other instruments of title as may be necessary, and generally to exercise in respect of the said land all the jurisdiction and powers conferred on the Native Land Court by subsection ten of section fourteen of “The Native Land Court Act, 1894.”

And it is hereby declared that this Order is made under the provisions in that behalf of “The Native Land Court Act, 1894,” and of “The Land Titles Protection Act, 1902,” and that this Order shall operate accordingly as a consent of the Governor in Council to the proceedings hereby authorised.

SCHEDULE.

ALL that parcel of land, containing 300 acres, more or less, situate at Thames, in the Provincial District of Auckland, and known as Kaikahu No. 3.

Regulations with respect to Appointment of King’s Counsel.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-first day of January, 1907.

Present:

THE HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

IN exercise of all powers and authorities vested in him in this behalf His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, hereby makes the following regulations with respect to the appointment of King’s Counsel.

REGULATIONS.

  1. THE appointment of His Majesty’s Counsel shall be made only by the Governor in Council, but with the concurrence in each case of His Honour the Chief Justice.

  2. On every appointment a fee of five guineas shall be paid for the patent.

  3. For every license to appear against the Crown in cases in which the services of His Majesty’s Counsel are dispensed with a fee of one guinea shall be paid.

  4. The foregoing fees shall be paid to the Treasury, and shall form part of the Consolidated Fund.

  5. Except when acting for the Crown, His Majesty’s Counsel shall not appear in the Supreme Court or Court of Appeal unless a junior from outside his own office appears with him, nor in any inferior Court unless upon special retainer and a fee of at least ten guineas.

Rotorua Acclimatisation District defined.

PLUNKET, Governor.

IN exercise and pursuance of the powers and authorities vested in me by “The Animals Protection Act, 1880,” and the Acts amending the same, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, do hereby appoint those parts of the said colony described in the Schedule hereto to be a district under and for the purposes of the said Act, and I do hereby declare that such district shall be known as the “Rotorua Acclimatisation District.”

SCHEDULE.

ROTORUA ACCLIMATISATION DISTRICT.

ALL that area bounded towards the north by Tauranga County: towards the east generally by Whakatane, Wairoa, and Hawke’s Bay Counties: towards the south by Hawke’s Bay and Waimarino Counties: and towards the north-west
