And whereas application has been made to His Excellency the Governor in Council to consent to the making of an application to the Chief Judge of the Native Land Court, in pursuance of the provisions of section thirty-nine of “The Native Land Court Act, 1894,” to amend the said order for the purpose of rectifying the said alleged error, mistake, or omission:

And whereas on inquiry held in pursuance of the provisions of “The Land Titles Protection Act, 1902,” the Governor is satisfied that a prima facie case has been established, and that it would be inexpedient to dispose of it by remedial legislation, or any other procedure which would obviate litigation:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of all powers and authorities in that behalf vested in him by “The Land Titles Protection Act, 1902,” and of every other power and authority enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the making of an application to the Chief Judge of the said Court in accordance with the provisions of section thirty-nine of “The Native Land Court Act, 1894,” for the purpose of rectifying the said alleged error, mistake, or omission, and that the said order of the said Court made the sixteenth day of July, one thousand eight hundred and ninety-two, and also the partition order for Umutahi C made the twenty-fifth day of August, one thousand eight hundred and ninety-two, may be the subject of an order of the said Chief Judge under the said section thirty-nine of “The Native Land Court Act, 1894.”

Prescribing Oyster License Fee for North Island.


PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-fourth day of April, 1907.

Present:

THE HONOURABLE W. HALL-JONES PRESIDING IN COUNCIL.

WHEREAS it is enacted by section five of “The Sea-fisheries Amendment Act, 1903,” that the annual fee payable in respect of a license under section sixteen of the principal Act shall be such sum (not exceeding two pounds) as the Governor in Council determines, and that such Order may apply generally to the whole of New Zealand, or to any specified part thereof, and so that such fee may vary in different parts of New Zealand:

And whereas the fee payable in respect of a license in the North Island and the islands adjacent thereto was, by Order in Council dated the thirtieth day of April, one thousand nine hundred and six, and published in the New Zealand Gazette of the thirtieth day of the same month, determined and declared to be one pound ten shillings:

And whereas it is desirable to revoke the said Order in Council of the thirtieth day of April, one thousand nine hundred and six, and to determine another fee in lieu of that determined in such Order in Council:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of the hereinbefore-recited power and authority, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the said Order in Council of the thirtieth day of April, one thousand nine hundred and six, and doth hereby determine and declare that the annual fee payable in respect of a license to take oysters under section sixteen of “The Sea-fisheries Act, 1894,” in the North Island and islands adjacent thereto shall be two pounds.

Domain Board appointed to have Control of the Taihape Domain.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirtieth day of April, 1907.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the power and authority conferred by “The Public Domains Act, 1881,” and the amendments thereof (including “The Domain Boards Act, 1904”), His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke a certain Order in Council, dated the twenty-fifth day of July, one thousand nine hundred and four, delegating powers to the Taihape Domain Board, and doth hereby appoint

WILLIAM JOHN HALL MCCORMICK,
JOHN SINCLAIR,
ARNOLD NORRIS ARROWSMITH, and
GEORGE BRAY

to be the Taihape Domain Board, having, subject to the said Acts, control of the lands described in the Schedule hereto, which lands are a public domain, and shall be called the Taihape Domain; and also doth hereby appoint Wednesday, the fifth day of June, one thousand nine hundred and seven, at half past seven o’clock p.m., as the time when, and the Public Hall, Taihape, as the place where, the first meeting of the said Board shall be held.


SCHEDULE.

TAIHAPE DOMAIN.

ALL that area in the Wellington Land District, containing by admeasurement 73 acres 2 roods 9 perches, more or less, being Sections Nos. 38, 39, 40, 41, 42, 43, and 44, Suburbs of Taihape, Block X, Township of Taihape, and Sections Nos. 96, 97, 98, and 99, Block XIV, Ohinewairua Survey District. Commencing at the eastern corner of Section No. 1, Block XVII, Township of Taihape, being also the northern corner of above-mentioned Section No. 38 (suburban); thence by the Hautapu River-bank Reserve, along that river to its junction with the Otaihape Stream; thence by the Otaihape Stream-bank Reserve to its junction with a public road forming the western boundary of Blocks IX and X, Township of Taihape, and Section No. 44 (suburban); thence by the said public road to its intersection by Tui Street; thence by that street to the northern corner of Block X, Township of Taihape; thence by a straight line from the said northern corner to the eastern corner of Block IX, Township of Taihape; thence by the eastern boundary of said Block IX to Huia Street; thence by that street in a generally northern direction forming the western boundary of Section No. 42 (suburban) to the northern corner of Section No. 21, Block III, Township of Taihape; thence by the main road in a north-easterly direction to the western corner of Section No. 6, Block XVII, Township of Taihape; thence by the south-western boundary of that section to its southern corner; and thence by the south-eastern boundary of Sections Nos. 6, 5, 4, 3, 2, and 1, Block XVII, Township of Taihape, to the point of commencement.

Also all that area in the Wellington Land District, containing by admeasurement 41 acres 3 roods 10 perches, more or less, being Section No. 35, Suburbs of Taihape. Bounded towards the north by Sections Nos. 28, 32, 33, and 34 (suburban); towards the east by the abutment of a public road and Block XIII, Township of Taihape; thence to the south-west and south-east by a public road; thence to the south-west and south-east by Block XI, Township of Taihape; towards the south-west by Adamson’s Track Road; thence to the north-west by Section No. 31 (suburban); and towards the west by Sections Nos. 31, 30, and 29 (suburban) to the point of commencement.

As the same are delineated on the plan marked L. and S. 55971, deposited in the Head Office, Department of Lands, at Wellington, and thereon coloured red.
