NATIVE LAND COURT NOTICES.
Order under Section 39 of “The Native Land Court Act, 1894.”
IN THE NATIVE LAND COURT OF NEW ZEALAND.
In the matter of Section 58 Block XII, Waikouaiti, and of an order of the above Court on investigation of title, dated the 26th day of March, 1887; and in the matter of an application, under section 39 of the said Act, by the District Land Registrar at Dunedin to amend the error in the said order by defining the meaning of the words “subject to water reserve,” which words are inserted in the said order, but by error or omission the meaning or purport of the same are not defined in the said order.
WHEREAS the said application was referred by the Chief Judge of the said Court to the Native Land Court for inquiry and report, and the same has been duly reported on:
Now, therefore, for the purpose of rectifying the said error and defining the meaning of the said words, and in exercise of the powers vested in me as Chief Judge of the Native Land Court, I hereby order as follows: That the meaning of the said words is, “Subject to an easement or right to and for all the owners, their successors, lessees, and assigns, of and in the said Block XII to enter upon said Section 58 for the purpose of drawing water and taking the same away from the spring situated at the head of the stream shown on the plan in the said order; provided that such easement shall only be exercised when drinkable water cannot be obtained from such stream at the road shown on the said plan.” The said order is hereby amended accordingly.
As witness my hand, this 7th day of January, 1907.
JACKSON PALMER, Chief Judge.
Order under Section 39 of “The Native Land Court Act, 1894.”
IN THE NATIVE LAND COURT OF NEW ZEALAND.
In the matter of the land known as Ohao No. 1 and Ohao No. 2, and of the investigation of title thereto; and in the matter of the application of Wiki te Paa to the Chief Judge of the Native Land Court, in pursuance of section 39 of “The Native Land Court Act, 1894,” in respect thereof.
WHEREAS the said application was referred to the Native Land Court for inquiry and report, and it appears upon inquiry held that the names of Wiki te Paa, Hemi te Paa, and Mei te Paa were by mistake omitted from the order of the Native Land Court, made on the 16th day of October, 1901, for Ohao No. 2, and the partition order of the said Ohao No. 2, and called Ohao No. 2B, made on the 3rd day of April, 1905, and that the said Wiki te Paa, Hemi te Paa, and Mei te Paa are entitled to a share or interest therein:
Now, therefore, I, the undersigned, Chief Judge of the said Court, in pursuance and exercise of the powers in that behalf conferred on me by the said section 39 of the said Act, and for the purpose of rectifying the said mistake, do hereby order that the said orders of the Court be amended by adding to the list of persons found entitled to the said land the names of Wiki te Paa, four shares; Hemi te Paa, three shares; and Mei te Paa, two shares, as owners of the said land.
As witness my hand, this 15th day of January, 1907.
JACKSON PALMER, Chief Judge.
