Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said streets:

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby approve the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said portions of streets within a distance of thirty-three feet from the centre-line of the said street.


SCHEDULE.

THOSE portions of streets known as Franklyn, Kawai, Motueka, and Te Pahi Streets, in the Nelson Land District and in the City of Nelson, surrounding Sections 927, 929, 931, 933, 935, 937, 939, and 941, in the said City of Nelson; as the said portions of streets are more particularly delineated on the plan marked R. 5649, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.

Exempting Tamar Street, Island Bay, City of Wellington, from the Provisions of Section 117 of “The Public Works Act, 1905,” subject to certain Conditions as to the Building-line.

At the Government House, at Wellington, this seventh day of January, 1907.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by section three of “The Public Works Act Amendment Act, 1906,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:

And whereas on the twentieth day of September, one thousand nine hundred and six, the Council of the City of Wellington, the local authority having control of the street known as Tamar Street, Island Bay, being the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on either side of the said street within a distance of thirty-three feet from the centre-line of the said street.

THAT street known as Tamar Street, in the Wellington Land District and in the City of Wellington, situated between Adelaide Road and Derwent Street, Island Bay; as the said street is more particularly delineated on the plan marked R. 8244, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.

Exempting Parts of Bulteel and Dawson Streets, Borough of New Plymouth, from the Provisions of Section 117 of “The Public Works Act, 1905.”

SCHEDULE.

THAT portion of the street in the Borough of New Plymouth, in the Taranaki Land District, known as Bulteel Street, from its junction with Dawson Street for a distance of 1 chain or thereabouts; also that portion of Dawson Street from its junction with Bulteel Street for a distance of 2¼ chains or thereabouts: as the said streets are shown on plan marked R. 8492, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and hatch-marked red thereon.

Licensing Messrs. Walker and Mason to use and occupy a Part of the Foreshore in Whirinaki River, Hokianga, as a Site for Timber Booms.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-first day of December, 1906.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned, John Walker, Victor Mason, and Herbert Mason, all of Waima-maku, Hokianga (hereinafter called “the licensees”), have applied to the Governor in Council for a license under “The Harbours Act Amendment Act, 1883” (hereinafter called “the said Act”), to occupy a part of the foreshore and land below low-water mark of the Whirinaki River, in the County of Hokianga, in order to construct and maintain thereon timber booms; and, in accordance with the one-hundred-and-fifty-sixth section of “The Harbours Act, 1878,” have deposited plans (in duplicate) in the office of the Marine Department at Wellington (marked M.D. 3020) showing the place where it is intended to construct such timber booms, the area of foreshore and land below low-water mark intended to be occupied for such purpose, and the manner in which it is proposed to carry out the work: And whereas it has been made to appear to the Governor in Council that the proposed work will not be or tend to the injury of navigation, and the said plans have, prior to the making of this Order in Council, been approved by the Governor in Council: And whereas it is expedient that a license under the said Act, for the purpose aforesaid, should be granted
