Inspection of Milk and Dairies, City of Auckland.

ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day of September, 1906.
Present:
His Excellency the Governor in Council.

IN pursuance of the powers vested in him by section three hundred and forty-six of “The Municipal Corporations Act, 1900,” His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulation:—
The Council of the City of Auckland is hereby authorised to make regulations for the purposes mentioned in section three hundred and forty-six of “The Municipal Corporations Act, 1900,” subject, however, to the following conditions, that is to say:—
(1.) The regulations shall not apply, and shall expressly state that they do not apply,—
(a.) To any dairy duly registered under “The Dairy Industry Act, 1898”; or
(b.) To vehicles, utensils, machinery, apparatus, or appliances used in or about any such dairy by the owner of the dairy, except in so far as the same are also used in or about any premises to which the regulations lawfully apply; or
(c.) To the owner of such dairy or any person employed by him in or about the dairy, except in so far as he or such person is the owner of any premises to which the regulations lawfully apply or is employed in or about the same.
(2.) A copy of every regulation made by the Council under the powers hereby conferred shall be forwarded to the Colonial Secretary within seven days after the making of the same, and the Colonial Secretary may at any time within six months of the making of such regulation disallow the same.

Fixing Dues for Use of Waitemata County Council’s Wharf, Waiwera River.

PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day of September, 1906.
Present:
His Excellency the Governor in Council.

WHEREAS by an Order in Council dated the third day of July, one thousand nine hundred and two, and published in the New Zealand Gazette No. 55, of the tenth day of the same month, the Waitemata County Council were licensed to use and occupy for a term of fourteen years from that date a part of the foreshore and of the land below low-water mark adjacent thereto at the mouth of the Waiwera River, in Hauraki Gulf, for the purpose of erecting and maintaining thereon a wharf in accordance with plan marked M.D. 2535, and deposited in the office of the Marine Department at Wellington:
And whereas such wharf has been erected, and by Order in Council dated the twenty-sixth day of June, one thousand nine hundred and five, dues and rates were prescribed for the use of the said wharf: And whereas it is desirable to add to the rates and dues so prescribed:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in pursuance and exercise of the power and authority conferred upon him by “The Harbours Act, 1878,” and of all other powers and authorities enabling him in that behalf, doth hereby prescribe that the additional dues and rates set forth in the Schedule hereto shall, on and after the date of the publication of this Order in Council in the New Zealand Gazette, be charged and taken by the said County Council for the use of the said wharf.


SCHEDULE.
SHIPPING WHARFAGE.

  1. For every passenger landed on the said wharf by means of a boat or other tender from any vessel lying away from such wharf, the sum of twopence, and the owner of the vessel from which the passenger is landed shall pay such charge to the said Council immediately on the landing of such passenger.
  2. The master of any such vessel landing passengers as aforesaid shall furnish to the said Council a certified statement of the number of passengers so landed.

Revoking Order in Council licensing the Havelock Town Board to use and occupy a Part of the Foreshore of Havelock Harbour as a Site for a Building for a Wharf.

ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day of September, 1906.
Present:
His Excellency the Governor in Council.

WHEREAS by an Order in Council dated the twenty-second day of May, one thousand nine hundred and five, and published in the New Zealand Gazette No. 52, of the first day of June in the same year, His Excellency the Governor in Council did, in pursuance of the provisions of “The Harbours Act Amendment Act, 1883,” license the Havelock Town Board to use and occupy a part of the foreshore and land below low-water mark in Havelock Harbour for the purpose of erecting and maintaining thereon a wharf in the position shown on and in accordance with plans marked M.D. 763 and 2820, and deposited in the office of the Marine Department at Wellington, and upon and subject to the terms and conditions therein set forth:
And whereas the said Board desires that the said license should be revoked:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of all the powers enabling him in that behalf, doth hereby revoke and determine the said recited Order in Council of the twenty-second day of May, one thousand nine hundred and five, and the rights and privileges granted thereby.

Vesting Management of Havelock Wharf in Havelock Harbour Board.

PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day of September, 1906.
Present:
His Excellency the Governor in Council.

WHEREAS by section fourteen of “The Harbours Act, 1878,” it is enacted that the Governor in Council may vest the management of any wharf the property of His Majesty in any local governing body or person, upon such terms and conditions as the Governor in Council thinks fit:
And whereas it is provided by the seventeenth section of the said Act that in and by such Order in Council it may be prescribed what dues and rates shall be taken by the body or person in whom any such wharf shall be vested as aforesaid:
And whereas it is thought desirable to vest the management of the wharf at Havelock in the Havelock Harbour Board, on the terms and conditions set forth in the First Schedule hereto; to prescribe that the dues and rates specified in the Second Schedule hereto shall be charged and taken, on and
