Appointing Returning Officer, Polling-places, and Day for
First Election of Members of Havelock Harbour Board.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-
third day of January, 1906.

Present:

THE HONOURABLE SIR J. G. WARD, K.C.M.G., PRE-
SIDING IN COUNCIL.

WHEREAS it is enacted by the sixth section of “The
Havelock Harbour Board Act, 1905,” that the
Governor may, by Order in Council gazetted, appoint a
Returning Officer and polling-places for the purpose of the
first election of members under that Act, and a day for
such election:

And whereas it is desirable to appoint a Returning Officer,
polling-places, and a day for such election:

Now, therefore, His Excellency the Governor of the
Colony of New Zealand, in exercise of the hereinbefore-
recited power and authority, and acting by and with the
advice and consent of the Executive Council of the said
colony, doth hereby appoint ROBERT STANSFIELD to be Re-
turning Officer, and the following places—viz., for the Town
District of Havelock, the Town Board Office, Havelock;
for the Kaituna Subdivision of the Pelorus Road District,
included in the harbour district, the Havelock Suburban
Post-office—to be polling-places for the first election of mem-
bers under the said Act; and doth also appoint Wednesday,
the fourteenth day of February, one thousand nine hundred
and six, to be the day for such election.

Appointing Assessors under “The Government Valuation of
Land Act Amendment Act, 1900.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-
third day of January, 1906.

THE HONOURABLE SIR J. G. WARD, K.C.M.G., PRE-
SIDING IN COUNCIL.

IN pursuance and exercise of the power and authority
vested in him by “The Government Valuation of Land
Act Amendment Act, 1900,” His Excellency the Governor
of the Colony of New Zealand, acting by and with the
advice and consent of the Executive Council of the said
colony, doth hereby appoint the persons named in the
Schedule hereto to be members of the Assessment Court
for the special district set opposite the name of each re-
spectively.

Validating the Public Notification of the Intention to raise
the Loan of £2,000 for the Extension of the Existing
Bridge across the Waioeka River and the Construction of
an Embankment from the End of such Extension to the
Western Bank of the said River, applied for by the Opo-
tiki County Council.

WHEREAS the Opotiki County Council lately pro-
posed to raise a loan of two thousand pounds under
“The Local Bodies’ Loans Act, 1901,” for the extension of
the existing bridge across the Waioeka River and the con-
struction of an embankment from the end of such exten-
sion to the western bank of the said river: And whereas
the public notification of the intention to raise the said
loan was published in four issues of the Opotiki Herald,
but only in three of the four weeks as required by section
eight of “The Local Bodies’ Loans Act, 1901”: And
whereas it appears that the ratepayers have not been
misled by such irregularity, and it is expedient to validate
the same:

Now, therefore, His Excellency the Governor of the
Colony of New Zealand, in pursuance and exercise of the
power conferred by section ten of “The Local Bodies’ Loans
Amendment Act, 1902,” and acting by and with the consent
of the Executive Council of the said colony, doth hereby
declare that such public notification of the intention to
raise the said loan shall be deemed and taken to be as valid
as though the said notification had been properly published,
and that the proceedings relative to the said loan shall not
be called in question by reason only of the irregularity
aforesaid.

Licensing G. B. Watson to use and occupy Part of the
Foreshore near Pakawau, Golden Bay, as a site for a
Wharf.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-
third day of January, 1906.

Present:

THE HONOURABLE SIR J. G. WARD, K.C.M.G., PRE-
SIDING IN COUNCIL.

WHEREAS, there being no Harbour Board empowered
to grant the license hereinafter mentioned, Garden
Boyd Watson (hereinafter called “the licensee”) has ap-
plied to the Governor in Council for a license under “The
Harbours Act Amendment Act, 1883” (hereinafter called
“the said Act”), to occupy a part of the foreshore and land
below low-water mark near Pakawau, Golden Bay, abutting
on parts of Sections 10, 11, and 12 of Block VI., Pakawau,
in the Provincial District of Nelson, in order to erect and
maintain a wharf thereon; and, in accordance with the one-
hundred-and-fifty-sixth section of “The Harbours Act,
1878,” has deposited a plan in the office of the Marine Depart-
ment at Wellington, marked M.D. 2917, showing the place in
the said bay where it is intended to construct such wharf,
and the area of foreshore and land below low-water mark
intended to be occupied for such purpose: And whereas
it has been made to appear to the Governor in Council
that the proposed work will not be or tend to the injury
of navigation, and the said plan has, prior to the making of
this Order in Council, been approved by the Governor in
Council: And whereas it is expedient that a license under
the said Act for the purpose aforesaid should be granted
and issued to the licensee on the terms and conditions here-
inafter expressed :
