Defining District within which Liquor shall not be supplied to Maoris.

PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-third day of July, 1906.

Present:

His Excellency the Governor in Council.

WHEREAS by section forty-six of “The Licensing Acts Amendment Act, 1904,” it is enacted that every person (whether a licensed person or not) who supplies liquor to any Maori for consumption off the premises within such parts of the colony as may be defined by the Governor in Council and gazetted is liable to a fine not exceeding fifty pounds:

And whereas it is expedient to define a part of the colony as aforesaid within which liquor shall not be supplied to Maoris for consumption off the premises:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power conferred upon him by the said section forty-six of “The Licensing Acts Amendment Act, 1904,” and acting by and with the consent and advice of the Executive Council of the said colony, doth hereby define the parts of the colony known as the Tongariro Maori Council District, the Matatua Maori Council District, the Horouta Maori Council District, the Takitimu Maori Council District, and the Kahungunu Maori Council District, the boundaries whereof are set out in the Schedule hereto, and doth hereby declare such parts of the colony to be a district within which liquor shall not be supplied to any Maori for consumption off the premises.

SCHEDULE.

TONGARIRO DISTRICT.

Bounded towards the north generally by the Waikato River from its confluence with the Kopokorahi Stream to the southern boundary of Te Arawa Maori Council District; thence by the said Te Arawa District to the western boundary of the Matatua District hereinafter described; thence towards the east generally by the said Matatua District to the Napier-Taupo Road at or near Runanga; thence by a right line to the intersection of the 39th parallel of south latitude by the meridian of 176° 30′ east longitude; thence by a right line to Otupae Mountain (Trig. Station No. 9); thence by the summit of the Ruahine Range to a point due east of the source of the Kawhatau River: thence towards the south generally by a right line to the source of the said Kawhatau River, and by that river to its confluence with the Rangitikei River: thence towards the south-west generally by the Rangitikei River to its confluence with the Hautapu River, and by the said Hautapu River to the Waiouru-Te Horo Road; thence by that road to Waiouru; thence by a right line to the confluence of the Wanganui River with the Pungapunga River; thence by a right line to the confluence of the Ongaruhē River with the Taringamutu River: thence towards the north-west by the Maniapoto District to the confluence of the Waikato River with the Kopokorahi Stream, the place of commencement.

MATATUA DISTRICT.

Bounded towards the north generally by the ocean from the mouth of the Rangitaiki River to the northernmost corner of Opape Native Reserve No. 1 (5570A): thence towards the east generally by the Horouta District, hereinafter described, to the Motu River; thence by a right line to Trig. Station, Maungatapere; thence by a right line to the confluence of the Ruakituri River with the Mangarewarewa Stream: thence towards the south-east by a right line in the direction of Runanga as far as the Taupo-Napier Road: and thence towards the west generally by a right line to Trig. Station No. 74. Ngapuketura; thence by a right line to Trig. Station No. 16, Putauaki (Mount Edgecombe); thence by a right line to the southernmost corner of Matata Township; and thence by that township and the Rangitaiki River to the place of commencement.

HOROUTA DISTRICT.

Bounded towards the north-west and north generally by the ocean from the northernmost corner of Opape Native Reserve No. 1 (5570A), near Tarakeha, to East Cape: thence towards the east generally by the ocean to a line drawn from the confluence of the Motu River with the Whahunga Stream over Trig. Station No. 184, Tawhiti, to the sea-coast: thence towards the south generally by that line to the said confluence of the Motu River with the Whahunga Stream: thence again towards the south-east by the Motu River to the Opotiki-Ormond Road: thence towards the south-west generally by that road to the southern boundary-line of the Waioeka Parish; thence by the said Waioeka Parish and the Opape Native Reserves to the place of commencement: including adjacent islands.

TAKITIMU DISTRICT.

Bounded towards the north by the Horouta District, hereinafter described, from the confluence of the Motu River with the Whahunga Stream to the ocean: thence towards the east generally by the ocean to the northern boundary of Paritu No. 4 Block: thence towards the south generally by a right line to the confluence of the Hangaroa River with the Ruakituri River; and thence by the said Ruakituri River to its confluence with the Mangarewarewa Stream: and thence towards the west generally by the Matatua and Horouta Districts, hereinafter described, to the place of commencement.

KAHUNGUNU DISTRICT.

Bounded towards the north-east generally by the Takitimu District, hereinafter described, from the confluence of the Ruakituri River with the Mangarewarewa Stream to the ocean; thence towards the east by the ocean; thence towards the south generally by Hawke’s Bay to the mouth of the Waikare River; thence towards the south-west by a right line running in the direction of a point on the Waiau River at the northernmost corner of the Maungataniwha Block as far as the southern boundary of the Matatua District, hereinafter described; and thence towards the north-west by the said Matatua District to the place of commencement.

Licensing the Karamea Sawmilling Company (Limited) to use and occupy a Part of the Tidal Land of Karamea River as a Site for Wharf Extension.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-third day of July, 1906.

Present:

His Excellency the Governor in Council.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned under “The Harbours Act Amendment Act, 1883” (hereinafter called “the said Act”), the Karamea Sawmilling Company (Limited), (hereinafter called “the company”), did, in the year one thousand nine hundred and five, apply to the Governor in Council for a license under the said Act to occupy a part of the foreshore and land below low-water mark of the Karamea River, West Coast, South Island, in order to construct a wharf thereon; and, in accordance with the one-hundred-and-fifty-sixth section of “The Harbours Act, 1878,” deposited a plan in the office of the Marine Department at Wellington (marked M.D. 2817) showing the area of foreshore and land below low-water mark intended to be occupied, and the manner in which it was proposed to construct the wharf: And whereas the Governor in Council did, on the twenty-third day of January, one thousand nine hundred and six, approve of the purpose for which the said foreshore and land below low-water mark was to be occupied, and granted a license for the purpose aforesaid on the terms and conditions therein expressed: And whereas the company has applied for authority to extend the said wharf described in the said Plan M.D. 2817; and, in accordance with the provisions of section one hundred and fifty-six of “The Harbours Act, 1878,” has deposited a plan in the office of the Marine Department at Wellington (marked M.D. 2980), such plan being supplementary to the above-mentioned Plan M.D. 2817, showing the additional land below low-water mark intended to be so occupied and the nature and extent of the addition to be made to the wharf: And whereas it is expedient that a license should be granted and issued to the company under the said Act, for the purpose aforesaid, on the terms and conditions hereinafter expressed:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said colony, doth hereby approve of the purpose for which the said license is required by the company as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the company to use and occupy that part of the land below low-water mark on which the extension of the said wharf is to be constructed, as shown on the Plan M.D. 2980 so deposited as aforesaid, for the purpose of constructing and maintaining the extension of the said wharf thereon, such license to be held and enjoyed by the company upon and subject to the terms and conditions set forth in the Schedule hereto.
