The functions and powers of the Colonial Secretary under these regulations may be exercised either by him or by any member of the Executive Council, being a responsible Minister of the Crown, who for the time being is acting for him.

Subject to these regulations, the Commissioners may regulate their own procedure.

Regulations for Examination and Licensing of Colonial Pilots.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this sixth day of April, 1906.
Present:
THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.
WHEREAS it is enacted by section one hundred and ninety of "The Shipping and Seamen Act, 1903," that the Governor in Council may from time to time make regulations determining the qualifications in respect of age, time of service, skill, character, and otherwise to be required from persons applying to be appointed or licensed as colonial pilots, and prescribing their duties:
And whereas regulations for licensing colonial pilots were made by the Governor on the thirteenth day of February, one thousand nine hundred, and published in the New Zealand Gazette of the fifteenth day of the same month, and it is desirable to revoke such regulations and make others in lieu thereof:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of the hereinbefore-recited power and authority, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the said regulations of the thirteenth day of February, one thousand nine hundred, and in lieu thereof doth hereby make the following regulations:—
REGULATIONS.

An applicant for a colonial pilot's license must hold a certificate of competency of a grade not lower than that of master, ordinary (foreign-going), and must have served continuously for either one year as master, or three years as first mate, or five years as second mate of a vessel of not less than 150 tons register trading on the coast of New Zealand: Provided that, in computing such service in any specified capacity, service in a higher capacity shall be included; provided further that the qualifying service must have been for three years within the last six years, or for two years within the last five years, or for one year within the last two years immediately preceding the date of his application for examination.

If the applicant does not hold the master's certificate, or has not performed the service required under the last preceding clause hereof, it shall be sufficient if he has served two years within the last five years next prior to his application in one of His Majesty's vessels stationed in New Zealand in a capacity not lower than that of navigating sub-lieutenant.

The applicant must pass an examination before an Examiner of Masters and Mates in the following subjects:—
(a.) In the colour test as prescribed in the regulations for the examination of masters and mates.
(b.) Knowledge of the number, description, and characteristics of the New Zealand lights, and as to which of them are connected with the telegraph system of the colony.
(c.) Knowledge of the New Zealand coasts and of the magnetic and true courses between all prominent headlands on the New Zealand coasts.
(d.) Knowledge of the anchorages, harbours of refuge, and roadsteads on the New Zealand coasts, and of the dangers lying off the coasts.
(e.) Knowledge of times of high water on the New Zealand coasts, the direction and set of the tides, ebb and flood, and of the currents. -
The examinations shall be conducted by the Examiners of Masters and Mates at places where such Examiners are stationed.

Every application for a colonial pilot's license shall be made in writing to the Secretary of the Marine Department.

Every applicant must submit, with his application, satisfactory evidence of his status and service, and also of good conduct and sobriety during the twelve months immediately preceding the date of his application.

A fee of £1 will be charged for each examination, half of which will be returned in case of failure to pass.

A fee of £2 will be charged on the first issue of a license.

The licenses shall be issued by the Secretary of the Marine Department at Wellington, and shall be in the form set forth in the Schedule hereto.

Every license shall continue in force for a term of twelve months only, but may be annually renewed on payment of a fee of 10s. for each annual renewal: Provided that if the renewal is not taken out within seven days after the expiration of the current term a fee of £2 will be charged, as in the case of a new license, in lieu of the ordinary renewal fee of 10s., and the applicant may be required to produce a satisfactory certificate of good conduct and sobriety during the twelve months immediately preceding the date of his application for the renewal.

The renewal shall be by indorsement on the license of the following memorandum under the hand of the Secretary of the Marine Department:—
"Renewed for a term of one year from the day of , 1 , being the day of the expiry of the previous term.
"Dated this day of , 1 .

All the provisions of "The Shipping and Seamen Act, 1903," relating to investigations into alleged incompetency or misconduct, and to preliminary inquiries and formal investigations into shipping casualties, shall apply to colonial pilots as fully and effectually, to all intents and purposes, as to masters and mates.

Pursuant to section 190 of "The Shipping and Seamen Act, 1903," A. B., of , born at , on the day of , 1 , is hereby licensed to be a colonial pilot whilst this license continues in force.
This license continues in force for twelve months only, and expires on the day of , 1 , but may be annually renewed.
This license is granted by examination.

At the Government Buildings, at Wellington, this sixth day of April, 1906.

THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.
WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned, under "The Harbours Act Amendment Act, 1883" (hereinafter called "the said Act"), the Akaroa Borough Council (hereinafter called "the Council"), in the year one thousand eight hundred and eighty-seven, applied to the Governor for a license under the said Act to occupy a part of the foreshore and the land below low-water mark immediately contiguous to such foreshore at Akaroa, in Akaroa Harbour, in order to erect and maintain thereon a wharf; and, in accordance with the one-hundred-and-fifty-sixth section of "The Harbours Act, 1878," deposited plans in the office of the Marine Department at Wellington (marked M.D. 1333, 1334, 1335, and 1336), showing the manner in which it was proposed to construct such wharf, the place in the said harbour where it was intended to erect the same, and the area of foreshore or land below low-water mark intended to be occupied for such purpose: And whereas it was made to appear to the Governor in Council that the proposed work would not be or tend to the injury of navigation, and the said plans were approved by the Governor in Council, with the modifications noted on the plan marked M.D. 1334: And whereas, pursuant to such application, a license was, by Order in Council dated the twenty-eighth day of June, one thousand eight hundred and eighty-seven, and published in the New Zealand Gazette of the thirtieth day of June in the
