As the said roads are more particularly delineated on the plan marked R. 6740, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and coloured blue thereon.

Exempting certain Streets in the Borough of Lower Hutt from the Provisions of Section 3 of “The Public Works Act, 1903.”


PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirtieth day of October, 1905.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section three of “The Public Works Act, 1903,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas on the twenty-eighth day of August, one thousand nine hundred and five, the Council of the Borough of Lower Hutt, the local authority having control of the public streets known as Valentine, Fitzherbert, and Buckley Streets (being the streets described in the Schedule hereto), did by resolution declare that the provisions of the said section three should not apply to the said streets: And whereas such resolution was in the following terms: “Resolved, That section three of ‘The Public Works Act, 1903,’ shall not apply to that portion of the public road fronting Allotments 197 and 51, nor to that portion of Valentine Street fronting Allotments 51 and 50, nor to that portion of Fitzherbert Street fronting Sections 50 and 197, nor to that portion of Buckley Street fronting Allotment 197; which several streets and allotments are delineated upon deposited plan No. 50 of the Township of Alicetown, within the Borough of Lower Hutt, the said public road, Fitzherbert Street, Valentine Street, and Buckley Street being under the control of the Lower Hutt Borough Council”:

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and in exercise of the powers conferred by the above in part recited Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby approve the said resolution.


SCHEDULE.

That portion of a public road fronting Allotments 197 and 51 a distance of 200 ft., or thereabouts, also that portion of the street known as Valentine Street fronting Sections 51 and 50, also that portion of the street known as Fitzherbert Street abutting on Sections 50 and 197, and also that portion of the street known as Buckley Street abutting on Allotment 197; all of the Township of Alicetown, within the Borough of Lower Hutt; as the said road and streets are more particularly delineated on the plan marked R. 6854, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured with a red border.

Domain Board appointed to have Control of the Paiaka Domain.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirtieth day of October, 1905.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section nine of “The Domain Boards Act, 1904” (hereinafter termed “the said Act”), it is enacted that the Governor may from time to time, by Order in Council gazetted, appoint any local authority to be the Domain Board having, subject to “The Public Domains Act, 1881,” control of any public domain;

And whereas by an Order in Council made under the provisions of “The Public Reserves Act, 1881,” on the twenty-fifth day of September, one thousand nine hundred and five, and published in the New Zealand Gazette of the twenty-eighth day of September, one thousand nine hundred and five, the land described in the Schedule hereto was brought under the operation of and declared to be subject to the provisions of “The Public Domains Act, 1881”:

And whereas it appears expedient to appoint a Domain Board to control the said domain:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby appoint

THE RAGLAN COUNTY COUNCIL

to be the Paiaka Domain Board, having control of the domain described in the said Schedule hereto for the purposes of and subject to the provisions of the said Act; and doth hereby appoint Wednesday, the twenty-second day of November, one thousand nine hundred and five, at half past two o’clock p.m., as the time when, and the Raglan County Council Office, Ngaruawahia, as the place where, the first meeting of the Board shall be held.


SCHEDULE.

PAIAKA DOMAIN.

All that area in the Auckland Land District, containing by admeasurement 22 acres 3 roods 8 perches, more or less, being portions of Sections Nos. 180, 181, and 182, Parish of Waipa. Bounded by a line commencing at the south-eastern corner of Section No. 179, Parish of Waipa, and proceeding thence in a north-westerly direction along the north-eastern boundary-line of the said Section No. 179 a distance of 509 links; thence along a line in a north-easterly direction, bearing N. 86° 54′ E., a distance of 1171 links; thence along a line in a south-easterly direction, bearing S. 68° 56′ E., a distance of 906 links; thence along a line in a south-easterly direction, bearing S. 9° 50′ E., a distance of 650 links; thence along a line in a north-easterly direction, bearing N. 85° 9′ E., a distance of 1295 links to a point on the south-western boundary-line of Section No. 184, Parish of Waipa, distant 552 links north-westerly along the said boundary-line from the south-western corner of said Section No. 184, on the Waingaro–Ngaruawahia Road; and thence westerly by the last-mentioned road to the point of commencement: be all the aforesaid linkages more or less: as the same is delineated on the plan marked S.G. 53336, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Vesting a Reserve in the Kiwitea County Council.


PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirtieth day of October, 1905.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been permanently reserved for gravel purposes:

And whereas, in the opinion of the Governor, it is expedient to vest the said reserve in the Kiwitea County Council:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in “The Chairman, Councillors, and Inhabitants of the Kiwitea County,” in trust, for gravel purposes.


SCHEDULE.

All that area in the Wellington Land District, containing by admeasurement 4 acres 3 roods 25 perches, more or less, being Section No. 22, Block XII., Hautapu Survey District; as the same is delineated on the plan marked S.G. 54477, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured red.
