Constituting the Town District of Waipukurau, in the County of Waipawa.

A PROCLAMATION.

WHEREAS it is enacted by “The Town Districts Act, 1904,” that, notwithstanding the repeal by “The Municipal Corporations Act, 1886,” of “The Town Districts Act, 1881,” and “The Town Districts Act 1881 Amendment Act, 1883,” the Governor may, in the manner prescribed by “The Town Districts Act, 1881,” declare that any area wherein there are not less than fifty householders shall be a town district, and thereupon the last-mentioned Act, and also “The Town Districts Act 1881 Amendment Act, 1883,” shall be in force in such town district: And whereas a petition has been presented to the Governor by the inhabitants within the area mentioned and described in the Schedule hereto, praying that such area may be constituted a town district under “The Town Districts Act, 1881”: And whereas the number of householders within such area is not less than fifty: And whereas not less than two-thirds of the number of resident householders within the said area have concurred in the said petition, and the said petition has been confirmed by a resolution passed by a majority of not less than two-thirds of the members of the Council of the County of Waipawa, being the county wherein the whole of the proposed town district is situate:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority vested in me by “The Town Districts Act, 1904,” and “The Town Districts Act, 1881,” and of all other powers enabling me in this behalf, do hereby proclaim and declare that the said area shall be a town district, and the same is hereby constituted a town district under “The Town Districts Act, 1881,” by the name of the Waipukurau Town District. And in further pursuance and exercise of the said powers I do hereby proclaim, declare, and appoint that the Board of Commissioners for the said district shall consist of seven members.


SCHEDULE.
WAIPUKURAU TOWN DISTRICT.

ALL that area in the Hawke’s Bay Land District, situated in Blocks XIV. and XV., Waipukurau Survey District. Bounded towards the north generally by the right bank of the Tukituki River from the northernmost corner of Section No. 244, Township of Waipukurau, to the north-eastern corner of Lot No. 1, shown on deposited plan No. 1667, deposited in the office of the District Land Registrar at Napier; thence towards the east generally by the eastern boundary-line of Lot No. 1 aforesaid, and the eastern boundary-lines of Lot No. 1, shown on deposited plan No. 1607, deposited in the office of the District Land Registrar at Napier, to the road forming the southern boundary of the last-mentioned lot; thence by a right line across the said road to the north-eastern corner of Lot No. 2; thence by the eastern boundary-lines of Lots Nos. 2, 3, and 7, and the eastern boundary-line of the last-mentioned lot produced to the southern side of road forming the southern boundary of the said Lot No. 7; thence towards the south generally by the southern side of the last-mentioned road to the south-eastern corner of Lot No. 4; thence by the southern boundary-lines of Lots Nos. 4 and 6 to the Waipukurau–Wanstead Road; thence by the eastern side of the last-mentioned road to a point in line with the southern boundary-line of the Waipukurau Cemetery; thence by a right line across the road to the south-eastern corner of the said cemetery; thence by the northern side of the road forming the southern boundary of the said Waipukurau Cemetery, and forming the southern boundary of Section No. 18, and its production across a road to the south-eastern corner of Section No. 23; and thence by the southern boundary-line of the said Section No. 23 to its westernmost corner; thence towards the north-west by the north-western boundary-lines of Sections Nos. 23, 22, 21, 20, 19, 27, and 26 to the railway reserve; thence by a right line across the railway reserve to the westernmost corner of Section No. 20; thence by the north-western boundary-lines of Sections Nos. 20, 19, 14, and 13 to a public road; thence by a right line across the said public road to the westernmost corner of Section No. 235; and thence by the north-western boundary-lines of Sections Nos. 235 and 244 to the Tukituki River, the place of commencement: as the same is delineated on plan marked S.G. No. 54516, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon bordered red.

Resuming Land held under Lease in Perpetuity for Scenery-preservation Purposes.

A PROCLAMATION.

WHEREAS by section one hundred and twenty-five of “The Land Act, 1892” (hereinafter termed “the said Act”), it is, inter alia, enacted that the Governor in Council may, by Proclamation, resume possession of any land leased under Part IV. of the said Act which in his opinion is required for any public purpose:

And whereas the lands described in the Schedule hereto form parts of lands which are held on lease in perpetuity from His Majesty the King under Part IV. of the said Act, dated the thirtieth day of June, one thousand eight hundred and ninety-eight: And whereas in the opinion of the Governor the lands described in the Schedule hereto are required for a public purpose, that is to say, for scenery-preservation purposes:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon me by section one hundred and twenty-five of “The Land Act, 1892,” and of all other powers and authorities in anywise enabling me in that behalf, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, do hereby proclaim and declare that I hereby resume possession of the lands mentioned in the Schedule hereto for the public purpose hereinbefore mentioned, the same being parts of the lands as held under lease as aforesaid; and do also hereby proclaim and declare that this Proclamation shall take effect on the first day of November, one thousand nine hundred and five.
