All in the Southland Land District; as the same are more particularly delineated on the plan marked and coloured as above mentioned, and deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District.

Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this second day of August, in the year of our Lord one thousand nine hundred and five.

Vesting Control of a Part of the Auckland Great South Road within the County of Eden between the Remuera Road Board and the One Tree Hill Road Board.

A PROCLAMATION.

WHEREAS by section one hundred and seven of “The Public Works Act, 1894,” it is provided that the Council of any county may, by special order, declare that all or any part of any district road shall, from and after a date to be fixed therein, be under the exclusive control of such local authority within the county as shall be mentioned in such special order, and may by the same special order direct that the cost of constructing and maintaining any such road or part of a road shall be borne either by the local authority to which the exclusive control thereof is given, or that a proportion of such cost, to be fixed in and by such special order, shall be borne by any other local authority or local authorities: And whereas by the said section it is also provided that the local authority to which such exclusive control shall be granted may recover from such other local authority or local authorities the share so fixed of any reasonable expenditure incurred in constructing and maintaining any such road or part of a road as aforesaid, in any Court of competent jurisdiction:

And whereas by subsection three of the said section it is further provided that wherever the operation of “The Counties Act, 1886,” or of any Act repealing or amending the same, is suspended the Governor shall have and may exercise all the functions vested in a County Council under the said section:

And whereas the road described in the Schedule hereto (hereinafter referred to as “the said road”) is a district road, declared as such by an Order in Council dated the fourteenth day of January, one thousand eight hundred and eighty-six, and is situated in a county within which “The Counties Act, 1886,” is suspended:

And whereas by a Proclamation dated the fourteenth day of July, one thousand eight hundred and eighty-eight, and published in the New Zealand Gazette on the nineteenth day of July, one thousand eight hundred and eighty-eight, pages 768 and 769, the said road was placed under the control of the Remuera Road Board, and it is now desirable to vary such control and to make other provision in lieu thereof as hereinafter appears:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers vested in me by “The Public Works Act, 1894,” and of every other power and authority enabling me in this behalf, do hereby revoke so much of the aforesaid Proclamation as vests the said road in the Remuera Road Board, and in lieu thereof do hereby order and declare that the portion of the said road which lies between the Junction Hotel and the eastern boundary-line of Lot 14, Section 11, Suburbs of Auckland, shall be under the exclusive care and control of the Remuera Road Board, and that the portion of the said road which lies between the Harp of Erin Hotel and the above-mentioned eastern boundary-line of Lot 14, Section 11, Suburbs of Auckland, shall be under the exclusive care and control of the One Tree Hill Road Board; and I further order and declare that this Proclamation shall come into operation and take effect on the fifteenth day of August, one thousand nine hundred and five.


SCHEDULE.

ALL that portion of the Auckland Great South Road commencing at its junction with the Auckland to Onehunga Road, opposite the Junction Hotel, and ending at the junction of the Panmure and Howick Road, opposite the Harp of Erin Hotel; as the said road is more particularly delineated on the plan marked R. 5268, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, coloured red thereon, and lettered A.B. and B.C.

Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this second day of August, in the year of our Lord one thousand nine hundred and five.

A PROCLAMATION.

BY virtue and in exercise of the powers and authorities vested in him by the two-hundred-and-forty-third section of “The Land Act, 1892,” and of every other power and authority enabling him in that behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and at the request of the School Commissioners of the Wellington Provincial District, in whom the land herein described is vested, doth hereby declare that the land described in the Schedule hereto, which has been reserved for educational purposes, shall be sold, subject to the provisions of “The Land Act, 1892.”


SCHEDULE.

WELLINGTON LAND DISTRICT.—SUBURBS OF MASTERTON.

Lots 5 and 6 and parts of Lots 4 and 7 of Section No. 101, Block I., Otahoua Survey District; area, 9 acres.

Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said colony, at the Government House, at Wellington, this seventh day of August, in the year of our Lord one thousand nine hundred and five.
