Taking the Flaxbourne Estate under “The Land for Settlements Consolidation Act, 1900,” and its Amendment.

A PROCLAMATION.

WHEREAS by a notice published in the New Zealand Gazette of the twelfth day of February, one thousand nine hundred and three, it was therein stated that it was the intention of the Governor to take compulsorily, under the powers in that behalf conferred by “The Land for Settlements Consolidation Act, 1900,” and its amendment, the lands mentioned in such notice:

And whereas, in pursuance of such notice, a claim for compensation was made by Sir George Hugh Charles Clifford, Bart., Walter Lovelace Clifford, Francis Charles Clifford, and Charles William Clifford, and the claim has been determined by the Compensation Court sitting at Blenheim, in the Provincial District of Marlborough, in manner provided by such Acts:

And whereas, in pursuance of the said Acts, an order was made by the said Court on the seventeenth day of December, one thousand nine hundred and four (now duly filed in the office of the Supreme Court at Blenheim aforesaid), declaring the land which the Minister is entitled to take, being the land specified in the Schedule hereto: And whereas, pursuant to leave granted by the said Court, the requisition of the Minister was duly amended, and the said claimants duly amended their claims: And whereas, in further pursuance of the said Acts, a separate order was made by the said Court sitting at Blenheim aforesaid on the nineteenth day of April, one thousand nine hundred and five, declaring the amount of compensation and costs to be paid in respect to the taking of such land, which order is now duly filed in the office of the Supreme Court at Blenheim:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred upon me by the said Acts, and of all other powers and authorities in anywise enabling me in that behalf, do hereby proclaim and declare that the land described in the Schedule hereto (being the land specified in the aforesaid Orders dated the seventeenth day of December, one thousand nine hundred and four, and the nineteenth day of April, one thousand nine hundred and five, respectively) is compulsorily taken under the said Acts.

SCHEDULE.

FLAXBOURNE SETTLEMENT.

ALL that area in the Marlborough Land District, containing by admeasurement 45,368 acres, more or less, and being sections and parts of sections as follows: Parts Sections 86, 87, and 88, Flaxbourne Crown-grant District, and parts Sections 262 and 263, Flaxbourne Run, Flaxbourne Crown-grant District, situated in Block XIV., Clifford Bay Survey District; also Sections 2, 4, 5, 6, part 8, part 9, 11 to 16, 20, 21 to 23, 21 to 23 again, 24 to 27, 29, part 31, 33, 34, 40 to 42, part 43, 44, part 45, part 46, part 47, 57, 61, 65, 68 to 85, 90, part 91, part 92, 94, 96, part 98, part 108, part 109, 110 to 114, part 115, part 116, part 123, part 124, part 125, part 126, 127 to 165, 176 of Square 38 to 178 of Square 38, and 179 to 204, Flaxbourne Crown-grant District; and Sections 171 to 173, 205 to 213, 226 to 237, 239, 240, part 241, part 242, 243 to 261, and 264, Flaxbourne Run, Flaxbourne Crown-grant District; all situated in Blocks 1, 2, 3, 4, 7, 8, 9, 10, 11, 12, 13, 14, 15, 17, Cape Campbell Survey District: as the same is delineated upon the plan marked S.G. 18886, deposited in the Head Office of the Lands and Survey Department, at Wellington, in the Wellington Land District, and thereon edged with red.

Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twenty-second day of May, in the year of our Lord one thousand nine hundred and five.
