[No. 44
Order under Section 39 of “The Native Land Court Act, 1894.”
IN THE NATIVE LAND COURT OF NEW ZEALAND.
In the matter of the land known as Motueka, Sections 163, 127, and 183, and of the succession to the interests therein of Te Rei Nganiho and Te Retimana te Rei; and of the application of Huhana Meihana, dated the 9th day of May, 1904, under section 39 of “The Native Land Court Act, 1894,” in respect thereof.
WHEREAS the said application was referred by me to the Native Land Court for inquiry and report: And whereas it appears that by succession orders dated the 2nd day of December, 1902, George Stockman, Sarah Marsh, Emma Rolfe, and Te Wharemawhai were determined to be the successors to the interests of the said Te Rei Nganiho in Motueka, Section 163, and of the said Te Retimana te Rei in Motueka, Sections 127 and 183:
And whereas it appears that other persons are entitled as successors to share in the several interests, and that their names were omitted from the said orders:
Now, therefore, I, the Chief Judge of the said Court, in exercise of the powers in that behalf conferred on me by the said section 39, and for the purpose of remedying the said omission, do hereby order that the said several succession orders be respectively amended by inserting therein the names of Eru Ihaka, Tuki Ihaka, Wiremu Ihaka, Ihaka Ihaka, and Huhana Meihana as successors, in addition to those determined by the said orders, and that the relative interests be determined in the manner following: George Stockman, m., ¹⁄₁₂; Sarah Marsh, f., ¹⁄₁₂; Emma Rolfe, f., ¹⁄₁₂; Te Wharemawhai, f., ¹⁄₄; Eru Ihaka, ¹⁄₁₆; Tuki Ihaka, ¹⁄₁₆; Wiremu Ihaka, ¹⁄₁₆; Ihaka Ihaka, ¹⁄₁₆; and Huhana Meihana, ¹⁄₄.
As witness my hand, this 15th day of March, 1905.
H. G. SETH-SMITH, Chief Judge.
