NATIVE LAND COURT NOTICES.

Order under Section 39 of “The Native Land Court Act, 1894.”

IN THE NATIVE LAND COURT OF NEW ZEALAND.

In the matter of the Kairakau No. 2 Block, and of the succession to the interests of Morena Hawea, deceased, and Mere Horo, deceased, therein; and in the matter of succession orders, made respectively on the 11th November, 1886, and 12th November, 1886, appointing successors to the said interests.

WHEREAS, by an order of the Native Land Court dated the 11th day of November, 1886, Hoani te Rangikangaiho and Tio Takopa were appointed successors to the interest of the said Morena Hawea in the said land: And whereas, by an order of the said Court dated the 12th day of November, 1886, Morehu Turoa and Tuahine Renata were appointed successors to the interests of the said Meri Horo therein: And whereas, by an Order in Council dated the 11th day of July, 1904, His Excellency the Governor, in exercise of the powers vested in him in that behalf by “The Land Titles Protection Act, 1902,” ordered that the provisions of section 39 of “The Native Land Court Act, 1894,” should apply in respect of the said succession orders, and authorised the Chief Judge of the Native Land Court, on receipt of an application in due form under the said section 39, to proceed accordingly: And whereas application under the said section 39 was, on the 27th day of July, 1904, made by Tuahine Renata, Morehu Turoa, and Tio Takopa for an amendment of the said succession orders:

And whereas the said application was referred by me as the Chief Judge of the Native Land Court to the said Court for inquiry and report: And whereas it appears that by mistake the words “by virtue of a certain will dated the 5th day of February, 1884,” were inserted in the said succession order dated the 11th day of November, 1886, and the words “by virtue of a certain will dated the 23rd day of July, 1884,” were inserted in the said succession order dated the 12th day of November, 1886:

Now, therefore, I, the said Chief Judge, in exercise of the powers in that behalf vested in me by the said section 39, do hereby order that the said succession orders be respectively amended in manner following, that is to say,—

  1. That the said succession order dated the 11th day of November, 1886, be amended by striking out therefrom the words “by virtue of a certain will dated the 5th day of February, 1884.”

  2. That the said succession order dated the 12th day of November, 1886, be amended by striking out therefrom the words “by virtue of a certain will dated the 23rd day of July, 1884.”
