potato disease (Phytophthora infestans), being diseases within the meaning of “The Orchard and Garden Pests Act, 1903”: And whereas in the opinion of His Excellency the Governor of the Colony of New Zealand diseased potatoes or potato-plants, or parts thereof, brought from the said portion of New Zealand are likely to spread disease:

Now, therefore, in pursuance and exercise of the powers conferred upon him by the said Act, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby absolutely prohibit the bringing of any potatoes or potato-plants, or any parts of potatoes or of potato-plants, which are affected with disease, into the portion of New Zealand specified in the First Schedule hereto from the portion of New Zealand specified in the Second Schedule hereto.

FIRST SCHEDULE.

PORTION OF NEW ZEALAND INTO WHICH DISEASED POTATOES, ETC., ARE PROHIBITED TO BE BROUGHT.

THE Counties of Clifton, Taranaki, Egmont, Stratford, Hawera, Patea, Waimarino, Waitotara, Wanganui, Rangitikei, Kiwitea, Pohangina, Oroua, Manawatu, Kairanga, Horowhenua, Featherston, Wairarapa South, Masterton, Castlepoint, Mauriceville, Eketahuna, Pahiatua, Woodville, Akitio, Weber, Patangata, Waipawa, Hawke’s Bay, Collingwood, Takaka, Waimea, Sounds, Marlborough, Kaikoura, and Cheviot; the boroughs adjoining thereto; and the Ports of Auckland, Gisborne, Onehunga, Kaipara, Lyttelton, Timaru, Oamaru, Port Chalmers, Dunedin, Bluff, Greymouth, and Westport.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this thirty-first day of January, 1905.

Present:

THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.

WHEREAS in accordance with the provisions of the third section of “The Land Drainage Act, 1904,” a majority of the ratepayers in the area of land described in the Schedule hereto, situated in the County of Waipa, have presented a petition to His Excellency the Governor of the Colony of New Zealand praying that the said area be constituted a drainage district under the provisions of the said Act:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority contained in the third section of “The Land Drainage Act, 1904,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby constitute and declare the area of land described in the Schedule hereto to be a district for the purposes of Part I. of the said Act, and to be called by the name of the “Ohaupo Drainage District”; and, also in pursuance and exercise of the power and authority contained in the fourth section of the said Act, doth hereby declare that the Board of Trustees for the said district shall consist of five members, to be elected under and in accordance with the said Act.

SCHEDULE.

OHAUPO DRAINAGE DISTRICT.

ALL that area in the Auckland Land District, situated in Ngaroto Parish, Hamilton Survey District, bounded towards the north by Section No. 338, Ngaroto Parish, from the south-western corner of the said Section No. 338 to a public road forming the western boundary of Section No. 322; thence towards the east by the said road forming the western boundaries of the said Section No. 322 and Sections Nos. 323 and 324 to the southern side of a road intersecting the first-mentioned road and forming the southern boundaries of Sections Nos. 324, 324A, and 95; thence again towards the north by the last-mentioned road to the northernmost corner of Section No. 309; thence again towards the east by the said Section No. 309 and by Section No. 310 to the south-western corner of the said Section No. 310; thence towards the south and again towards the east by Section No. 325 to the southernmost corner of the said Section No. 325; thence towards the south by a public road forming the northern boundaries of Sections Nos. 284, 285, 295, 300, 300A, 135, 134, 133, 143, and 142 to the south-eastern corner of Section No. 160; thence towards the west by the said Section No. 160 and by Section No. 159 to the northernmost corner of the last-mentioned section; thence towards the north-west by a public road forming the south-eastern boundaries of Sections Nos. 153, 369, 367, and 385, to a point in line with the south-eastern boundary-line of Section No. 380A (a closed road); thence by a right line across a public road to the said south-eastern boundary-line of the said Section No. 380A, and by that boundary-line to a point in line with the eastern boundary-line of Section No. 381; thence by a right line to the south-eastern corner of the said Section No. 381; thence by the said Section No. 381 and by Section No. 371 to the place of commencement.

HILLSIDE DRAINAGE DISTRICT.

ALL that area in the Auckland Land District, situated in the Parishes of Kirikiri roa and Komakorau, and Komakorau Survey District, and being part of the land granted to the New Zealand Loan and Mercantile Agency Company (Limited) by grant dated 20th July, 1876, and Sections Nos. 224, Parish of Komakorau, 96, 96A, 97, 98, 99, 100, 101, 102, 103, 104, 105, 105A, 303, 121A, 122A, 208A, 198A, part of 197A, 201, and 202, Parish of Kirikiri roa, containing by admeasurement 17,903 acres, more or less. Bounded towards the north by the Hukanui-Piako Road from the northernmost corner of Section No. 223 of the Parish of Komakorau to the northernmost corner of Lot 26, subdivision of the said land granted to the New Zealand Loan and Mercantile Agency Company (Limited) by grant dated 20th July, 1876: thence towards the east by the last-mentioned lot to the Waikato-Thames Railway: thence towards the south-east generally by the said Waikato-Thames Railway to Section No. 302, Parish of Kirikiri roa; thence by the said Section No. 302 of the Parish of Kirikiri roa to Lot 1 of the said land granted to the New Zealand Loan and Mercantile Agency Company (Limited); thence by the said Lot 1, and by part of Section No. 197A, and Sections Nos. 193, 194, and 195, of the Parish of Kirikiri roa, to a public road forming the eastern boundary of Section No. 190: thence towards the west generally by the said road forming the eastern boundaries of Section No. 190 and Sections Nos. 189, 188, 187, 185, 184, and 183 to the intersection of a road 100 links wide forming the south-eastern boundary of Section No. 126; thence by that road to a point in line with the eastern boundary of the said Section No. 126; thence by a right line to and by the north-eastern
