And I do further proclaim that such constitution shall take effect on and from the first day of November, one thousand nine hundred and four.

And I do hereby appoint Thomas Bolster Fairbairn (the Town Clerk to the existing City of Dunedin) to be the Town Clerk temporarily of the said united borough.

Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twelfth day of October, in the year of our Lord one thousand nine hundred and four.

Declaring Roads within the Borough of Petone to be under the Control and Management of the Borough.


PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this tenth day of October, 1904.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and in exercise of the powers vested in him by section one hundred and two of “The Public Works Act, 1894,” as amended by section six of “The Public Works Acts Amendment Act, 1900,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the roads described in the Schedule hereto, being roads constructed by the Governor within the limits of the Borough of Petone, shall be under the control and management of the Council of the Borough of Petone from and after the date of this Order in Council.


SCHEDULE.

ALL that road in the Wellington Land District known as the Titiro Moana Road, commencing at its junction with the Maungaraki Road, near the northern boundary of Subdivision 113 of Original Section 79, Block XIII., Belmont Survey District, and proceeding thence generally south-westerly and north-westerly until it reaches the north-eastern boundary of said Original Section 79, Block XIII., Belmont Survey District, the same being the boundary between the Petone Borough and the Hutt County, as shown by a red line dotted, the road being coloured green and marked C.E. on plan.

All the continuation of that road in the Wellington Land District known as the Maungaraki Road, commencing at its junction with the Korokoro Road, in the Korokoro Village Settlement, between the western boundary of Section 86 and a portion of Crown lands in Block XIII., Belmont Survey District, and proceeding thence generally northerly to its junction with the Akatea Road, near the north-western corner of Subdivision 118 of Original Section 79, Block XIII., Belmont Survey District, and proceeding thence in a north-westerly direction until it junctions with the Titiro Moana Road near the northern boundary of Subdivision 113 of Original Section 79, Block XIII., Belmont Survey District; proceeding thence generally to the north boundary of Original Section 79, Block XIII., Belmont Survey District, the same being the boundary of the Petone Borough and the Hutt County, as shown by red-colour dotted line, the road being coloured red and marked A.B.C.D. on plan.

Also all that road in the Wellington Land District known as the Akatea Road, commencing at its junction with the Maungaraki Road, near the north-western corner of Subdivision 118 of Original Section 79 of Block XIII., Belmont Survey District, and proceeding thence generally easterly, northerly, and south-easterly to the south-eastern boundary line of Subdivision 122 of Original Section 79 of Block XIII., Belmont Survey District, and coloured blue and marked B.G.H.I. on plan.

As the same are more particularly delineated on the plan marked R5161r and coloured as above mentioned, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District.

Declaring Roads in Hutt County to be County Roads.

At the Government House, at Wellington, this tenth day of October, 1904.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1894,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the roads in Hutt County described in the Schedule below shall, on and after the date of this Order in Council, be county roads.


SCHEDULE.

ALL that portion of road in the Wellington Land District known as the Maungaraki Road, commencing at the north-eastern boundary of Original Section 79, Block XIII., Belmont Survey District, the same being the boundary between the Petone Borough and the Hutt County, at a point opposite the boundary-line between Subdivisions 38 and 115, Maungaraki Settlement, and proceeding thence generally north-easterly until it reaches a point opposite the subdivision boundary-line of Sections 29 and 30 of the Maungaraki Settlement, in Block XIII., Belmont Survey District; coloured red and marked D.J. on plan.

All that portion of road in the Wellington Land District known as the Titiro Moana Road, commencing at the north-eastern boundary of Original Section 79, at the north-western corner of Subsection 111 of the same section, Block XIII., Belmont Survey District, the same being the boundary of the Petone Borough and the Hutt County, where the said Titiro Moana Road leaves the Petone Borough and proceeds north-westerly until it meets and ends at the south-eastern boundary of Section 39 (a forest reserve), Block XIII., Belmont Survey District; coloured brown and marked E.F. on plan.

All in the Wellington Land District; as the same are more particularly delineated on the plan marked R. 5161r, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District.

Revoking Regulations as to Size of Mesh of Trawl-nets, and making Others in lieu thereof.

ORDER IN COUNCIL.

At the Government House, at Wellington, this tenth day of October, 1904.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The Sea-fisheries Act, 1894” (hereinafter termed “the said Act”), it is, amongst other things, enacted that the Governor in Council may from time to time make regulations for the purposes therein mentioned, which shall have general force and effect throughout the colony, or particular force and effect only in any waters or places specified therein:

And whereas by Order in Council dated the nineteenth day of October, one thousand nine hundred and three, and published in the New Zealand Gazette No. 82, of the twenty-second day of the same month, certain regulations were made prescribing the size of mesh of trawl-nets:

And whereas it is expedient to revoke the said Order in Council of the nineteenth day of October, one thousand nine hundred and three, and the regulations made thereunder, and to make the regulations set forth in the Schedule hereto:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred upon him by the said Act, and of all other powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the said Order in Council of the nineteenth day of October, one thousand nine hundred and three, and the regulations made thereby, and doth hereby make the regulations set forth in the Schedule hereto; and with the like advice and consent doth order that the said regulations shall have force and effect throughout the colony on and after the first day of May, one thousand nine hundred and five.
