Cancelling Proclamation taking Land for a Further Portion of the Otago Central Railway, Manuherikia–Ophir Section, and for Road-diversions in connection therewith and Road-approaches thereto.

A PROCLAMATION.

WHEREAS by the twenty-second section of “The Public Works Act, 1894,” it is enacted that in any case where a Proclamation has been issued taking land for any public work, and where, before such Proclamation has been registered by the District Land Registrar, it is found that such Proclamation incorrectly describes the land purporting to be taken, the Governor may by a subsequent Proclamation cancel and annul such first-mentioned Proclamation, or any part thereof: And whereas a portion of the land mentioned in the Schedule to a Proclamation made under the said Act, dated the twentieth day of April, one thousand nine hundred and four, taking land for a further portion of the Otago Central Railway—viz., Manuherikia–Ophir Section—and for road-diversions in connection therewith and road-approaches thereto, and published in the New Zealand Gazette No. 33, of the twenty-first day of April, one thousand nine hundred and four, is incorrectly described, and such Proclamation has not been registered by the District Land Registrar as provided by the said Act:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, in exercise of the powers and authorities vested in me by “The Public Works Act, 1894,” do by this Proclamation hereby cancel and annul the said Proclamation dated the twentieth day of April, one thousand nine hundred and four, and published in the New Zealand Gazette of the twenty-first day of the month and year aforesaid, taking the land hereinbefore specified.

Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this thirteenth day of August, in the year of our Lord one thousand nine hundred and four.

A PROCLAMATION.

WHEREAS by the seventy-third section of “The Local Bodies’ Loans Act, 1901” (herein termed “the said Act”), it is, amongst other things, enacted that, before certain moneys therein mentioned shall be expended upon any block of land, it shall be necessary that the same be proclaimed as set apart for settlement:

Now, therefore, in pursuance and exercise of every power and authority enabling me in this behalf, and for the purposes of the said Act, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, do hereby proclaim the land described in the Schedule hereto as set apart for settlement.

SCHEDULE.

AUCKLAND LAND DISTRICT.

Waiotahi Block, 6,050 Acres (more or less).

ALL that area in the Auckland District, containing approximately 6,050 acres, situated in the Parish of Waiotahi, Opotiki County. Bounded towards the north-east by Sections Nos. 483, 399, and 393 of the Parish of Waiotahi, and by a road reserved along the left bank of the Waioeka River; towards the south-east generally by Sections Nos. 459 and 481 of the Parish of Waiotahi aforesaid, by a road reserve along the left bank of the Waioeka River, by Section No. 461 of the said parish, again by a road reserve along the left bank of the said Waioeka River, by the Ruahema Stream, and by Section No. 480 of the parish aforesaid; towards the south by Block II., Waioeka Survey District; towards the west generally by a public road; and towards the north-west by Section No. 479 of the Parish of Waiotahi aforesaid to the place of commencement: as the same is delineated upon the plan marked S.G. 23337, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon bordered red.

Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this seventeenth day of August, in the year of our Lord one thousand nine hundred and four.
