delegate all or any of the powers by the said Act conferred, save as is therein mentioned, to any person or persons, for any period, and subject to such stipulations as may be specified in such order, and that every such delegation may from time to time in like manner be altered or revoked: And whereas, pursuant to “The Public Reserves Act, 1881,” by an Order in Council of even date herewith, the land described in the Schedule hereto, situate in Canterbury Land District, is declared to be brought under the operation of and to be subject to the provisions of the said “Public Domains Act, 1881”:

Now, therefore, His Excellency the Governor, by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth hereby, and in respect of the land hereinafter mentioned, which shall be known as Pukaki Domain, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the Minister in Charge of the Department of Tourist and Health Resorts.

SCHEDULE.

ALL that area in Canterbury Land District, containing by admeasurement 176 acres, more or less, being Reserve No. 3701 (formerly part of Reserve No. 182), Block XIII., Pukaki Survey District. Bounded towards the north-east by Reserve No. 2927, Block XIII., Pukaki Survey District, the abutment of a public road, and by Run No. 217A of said block and survey district; towards the south-east by said Run No. 217A to a road reserve along the northern bank of the Pukaki River; and towards the west and north-west generally by said road reserve, by Reserve No. 2947 to the public road forming the eastern boundary of a reserve containing 20 acres, Block XIII., Pukaki Survey District, by said public road to a point in line with the north-eastern boundary-line of said reserve of 20 acres, across the said public road, and by the said north-eastern boundary-line to a road reserve along the southern shore of Pukaki Lake, and by the last-mentioned road reserve to the commencing-point: exclusive of a road 100 links wide which intersects the above-described boundary.

Also all that area in Canterbury Land District, containing by admeasurement 180 acres, more or less, being Reserve No. 3702 (formerly part of Reserve No. 183), Block XV., Pukaki West, and Block III., Strachey Survey Districts. Bounded towards the north-east by a road reserve along the southern shore of Pukaki Lake to the main road from Lake Pukaki to Ben Ohau Homestead, by said main road to a point in line with the south-western boundary-line of a reserve containing 20 acres, Block XV., Pukaki West, and Block III., Strachey Survey Districts, across the main road aforesaid, and by the said south-western boundary-line to Run No. 87, Block III., Strachey Survey District; towards the south-east by said Run No. 87; towards the south-west by Run No. 220, Block XV., Pukaki West, and Block III., Strachey Survey Districts, the abutment of the main road aforesaid, and again by the said Run No. 220; and towards the north-west by Run No. 219, Block XV., Pukaki West Survey District, to the commencing-point: exclusive of a road 100 links wide which intersects the above-described boundary.

As the same are delineated on the plan marked S.G. 50991, deposited in the Head Office, Department of Lands and Survey, at Wellington, in Wellington Land District, and thereon bordered red.

ORDER IN COUNCIL.

At the Government House, at Wellington, this eighth day of August, 1904.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the seventh day of December, one thousand eight hundred and ninety-eight, making delegation of certain powers in manner as therein appears; and doth hereby, with the like advice and consent, and in respect of the land hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the undermentioned persons, who shall be known as the Waihou Domain Board, namely,—

FRANCIS PAVITT,
ALEXANDER WATSON EDWARDS,
WILLIAM HETHERINGTON,
HUGH ROSS,
ANDREW JOSEPH FARMER,
THOMAS MCINDOE, and
RALPH LAKE SOMERS

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the first Friday in each month, at three o’clock p.m., at Te Aroha, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Friday, the second day of September, one thousand nine hundred and four.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any five members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Friday in February in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  7. If, by resignation, death, incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  8. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

And with the like advice and consent as aforesaid doth hereby also order that this delegation shall take effect in respect of the parcels of Crown land described in the Schedule hereto.

ALL that area in the Auckland Land District, containing by admeasurement 68 acres, more or less, being Section No. 113, Block IX., Te Aroha Survey District. Bounded towards the north-west by Sections Nos. 91 and 112; towards the north-east by the road reserve along the Waihou River; towards the south-east by the road forming the north-western boundary of a railway reserve; towards the south-west by a road forming the north-eastern boundaries of a railway-station reserve and Sections Nos. 69, 70, and 71, Block IX., Te Aroha Survey District.

Also all that area in the Auckland Land District, containing by admeasurement 39 acres 1 rood, more or less, being Section No. 8, Block XI., Te Aroha Survey District. Bounded towards the north by Section No. 13, Block IX.; towards the north-east by Section No. 90, Block XI.; towards the south-east by Section No. 6 of the said Block XI.; towards the south-west by a road forming the north-eastern boundary of Sections Nos. 7 and 5 of the said Block XI.; towards the north-west, again towards the south-west, and again towards the south-east by Section No. 8A, Block XI.; again towards the south-west by the last-mentioned road to the place of commencement.

As the same are delineated on the plan deposited in the District Lands and Survey Office, Auckland.
