Powers delegated to the Taihape Domain Board under "The Public Domains Act, 1881."

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of July, 1904.

Present:

His Excellency the Governor in Council.

IN pursuance and exercise of the powers and authorities vested in him by "The Public Domains Act, 1881," His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-first day of February, one thousand nine hundred and two, making delegation of certain powers in manner as therein appears; and doth hereby, with the like advice and consent, and in respect of the lands hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the undermentioned persons, who shall be known as the Taihape Domain Board, namely,—

WILLIAM AGATE ELLIS,
WILLIAM JOHN HALL McCORMICK,
JOHN SINCLAIR,
ARNOLD NORRIS ARROWSMITH, and
GEORGE BRAY,

all of Taihape (herein referred to as "the Board"), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the first Wednesday in each month, at half-past seven o’clock p.m., at the Public Hall, Taihape, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Wednesday, the seventh day of September, one thousand nine hundred and four.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall at their first meeting, and thereafter at an annual meeting to be held on the first Wednesday in February in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

  7. If, by resignation, death, incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

  8. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

And with the like advice and consent as aforesaid doth hereby also order that this delegation shall take effect in respect of the parcels of Crown lands described in the Schedule hereto.


SCHEDULE.

ALL that parcel of land in the Wellington Land District, containing by admeasurement 9 acres 3 roods 24 perches,

more or less, being Block X., Taihape Township. Bounded towards the north-east by a public road, 100 links wide; towards the south-east by Weka Street, 100 links wide; towards the south-west by a public road, 100 links wide; and towards the north-west by Tui Street, 100 links wide.

Also all those several parcels of land in the Wellington Land District, containing by admeasurement 97 acres 1 rood 23 perches, more or less, being Sections Nos. 35, 38, 39, 40, 41, 42, 43, and 44, Suburban, Taihape Township.

As the same are delineated on the plan deposited in the District Lands and Survey Office, Wellington.

Recreation Reserve in Auckland Land District brought under "The Public Domains Act, 1881."

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of July, 1904.

Present:

His Excellency the Governor in Council.

BY virtue of the powers and authorities vested in me by the twenty-fourth section of "The Public Reserves Act, 1881," I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, do hereby order and declare that the reserve for public recreation in the Auckland Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of "The Public Domains Act, 1881"; and such domain shall hereafter be managed, administered, and dealt with in manner directed by the said Act.


SCHEDULE.

ALL that area in the Auckland Land District, being Section No. 139 of the Parish of Whaingaroa, containing by admeasurement 17 acres and 16 perches, more or less. Bounded towards the north-east by the Waitetuna River from its confluence with the Mangakino River; towards the south-east by the abutment of a public road and Section No. 130A of the said Parish of Whaingaroa; towards the south-west by the said Section No. 130A, the crossing of a public road, and again by the said Section No. 130A to the Mangakino River; and towards the west generally by the Mangakino River to the point of commencement: excepting from the above-described area a road varying in width: as the same is delineated on the plan marked S.G. 49231, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured red.

Revoking the Delegation of Powers under "The Cemeteries Act 1882 Amendment Act, 1885," to the Wairoa County Council, in respect to the Frasertown Public Cemetery.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of July, 1904.

Present:

His Excellency the Governor in Council.

WHEREAS by an Order in Council issued on the twenty-ninth day of November, one thousand eight hundred and eighty-six, the powers conferred upon the Governor by section six of "The Cemeteries Act, 1882," as to the appointment and removal of trustees, were delegated to the Council of the County of Wairoa, in pursuance of section two of "The Cemeteries Act 1882 Amendment Act, 1885," in respect to the cemetery described in the Schedule hereto;

And whereas it is expedient to revoke the said delegation:

Now, therefore, His Excellency William Lee, Baron Plunket, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the delegation to the Council of the County of Wairoa of the powers conferred upon the Governor by section six of "The Cemeteries Act, 1882," in respect to the Frasertown Public Cemetery, described in the Schedule hereto.
