Consenting to closing Roads, Parish of Matakana, Matakana West Road District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twentieth day of June, 1904.

Present:

His Excellency the Governor in Council.

WHEREAS by section twelve, subsection one, of “The Public Works Acts Amendment Act, 1900,” it is enacted that a local authority shall not declare any county or district road to be stopped, and such road shall not be deemed to be stopped, until the consent thereto of the Governor by Order in Council gazetted is obtained:

And whereas the Matakana West Road Board has applied for such consent in respect to the roads described in the Schedule hereto:

Now, therefore, in pursuance and in exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the Matakana West Road Board closing the roads mentioned in the Schedule hereto.

Declaring Part of Waipuna Ridge Road, Waimarino County, a County Road.

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-seventh day of June, 1904.

Present:

His Excellency the Governor in Council.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1894,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the road described in the Schedule hereto shall, on and after the date of this Order in Council, be a county road.

SCHEDULE.

WAIPUNA RIDGE ROAD.

ALL that portion of the road in the Wellington Land District, Waimarino County, known as the Waipuna Ridge Road, commencing at its junction with the Pipiriki-Waiouru Road, and proceeding in a southerly direction along frontage of Section 2, through Section 3, and along frontage of Section 4, Block IX., Makotuku Survey District, terminating at the boundary between Sections 4 and 5, Block IX., Makotuku Survey District, being a distance of 2 miles 55 chains, or thereabouts: as the said road is delineated on the plan marked R. 3747, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, coloured red thereon, and marked A.B.

Validating Election of Board of Mount Roskill Road District, County of Eden.

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-seventh day of June, 1904.

Present:

His Excellency the Governor in Council.

WHEREAS the ratepayers of the Mount Roskill Road District failed to elect a Board within the time prescribed by “The Road Boards Act, 1882,” and such Board was not elected for the said district until the second week of May last, and it is expedient to validate such election:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers vested in him by the said “Road Boards Act, 1882,” doth hereby validate the above-mentioned election, and doth declare that the persons elected during the second week of May last as the Board of the said Mount Roskill Road District shall be the Board of the said district, in the manner as if such election had been regularly held.

Powers delegated to the St. Andrew’s Domain Board under “The Public Domains Act, 1881.”

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-seventh day of June, 1904.

Present:

His Excellency the Governor in Council.

IN pursuance and exercise of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twenty-fifth day of August, one thousand nine hundred and two, making delegation of certain powers in manner as therein appears; and doth hereby, with the like advice and consent, and in respect of the land hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the undermentioned persons, who shall be known as the St. Andrew’s Domain Board, namely,—

DAVID STOWELL,
GEORGE LYALL,
ANDREW MARTIN,
THOMAS GALLETLY, and
The Rev. THOMAS FARLEY

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the first Monday in each month, at eight o’clock p.m., at the Masonic Hotel, St. Andrew’s, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the first day of August, one thousand nine hundred and four.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Monday in February in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present
