NOTICE is hereby given that the several matters mentioned in the Schedule hereunder written will be heard by the Native Land Court sitting at Wellington on the 27th day of May, 1904, or as soon thereafter as the business of the Court will allow.

Order under Section 39 of “The Native Land Court Act, 1894.”

IN THE NATIVE LAND COURT OF NEW ZEALAND.

In the matter of the succession to the interest of Marutuna Tiriti, deceased, in Rotopounamu No. 1, and of the application of Karepe Tuhaha under section 39 of “The Native Land Court Act, 1894.”

WHEREAS the Native Land Court, by order dated the 17th day of December, 1896, appointed Karauria Puhikaru and Wiremu Tewi to succeed to the interest of the said Marutuna Tiriti, deceased, in Rotopounamu No. 1: And whereas the Court made the said order in the belief that there was no living person who was nearer of kin to the deceased than the said Karauria Puhikaru and Wiremu Tewi: And whereas it has since been ascertained that the said Karepe Tuhaha, the son of the said deceased, is her nearest living representative, and is the proper person to succeed to her interest in the said land:

Now, therefore, for the purpose of rectifying the said error, and in exercise of the power in that behalf vested in me as Chief Judge of the Native Land Court by section 39 aforesaid, I hereby order that the said order of the 17th day of December, 1896, appointing successors to the said Marutuna Tiriti be and the same hereby is amended by substituting the name of Karepe Tuhaha for those of the said Karauria Puhikaru and Wiremu Tewi as the sole successor to the said Marutuna Tiriti, deceased.

And whereas, since the making of the said order, the said Rotopounamu No. 1 has been partitioned, and the interest of the deceased has been awarded in Rotopounamu No. 1c: It is hereby further ordered that the name of the said Karepe Tuhaha be substituted for those of the said Karauria Puhikaru and Wiremu Tewi in the order ascertaining the title to Rotopounamu No. 1c so far as relates to the interest of the said Marutuna Tiriti, deceased.
