Conferring Jurisdiction on Native Land Court.
RANFURLY, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this seventeenth day of February, 1904.
Present:
His Excellency the Governor in Council.
WHEREAS by section fourteen of “The Native Land Court Act, 1894,” as amended by section forty-one of “The Native Land Claims Adjustment and Laws Amendment Act, 1901,” it is enacted that the Native Land Court shall, as regards all lands within the meaning of subsection ten of section fourteen aforesaid, have jurisdiction as in the said subsection mentioned: Provided that the Court shall not proceed to exercise such jurisdiction unless the Governor in Council shall by Order authorise the same to be done:
And whereas it is expedient that the Court should, for the purpose hereinafter mentioned, be authorised to exercise the jurisdiction conferred as aforesaid in respect of the land known as Taraketi No. 2E, containing 198 acres 1 rood 26 perches, more or less:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby authorise the said Court to exercise in respect of the said Taraketi No. 2E jurisdiction to determine who are the Natives entitled beneficially to such land by virtue of the trust expressed in the Crown grant thereof, and to order the inclusion of such Natives in the title, either together with or in lieu of the nominal owners or any of them, and for the purpose aforesaid to order the cancellation or amendment of any existing instrument of title, and the issue of such new Crown grants or other instruments of title as may be necessary, and generally to exercise in respect of the said land the jurisdiction and powers conferred on the Native Land Court by subsection ten of section fourteen of “The Native Land Court Act, 1894,” and its amendments, so far as the same may be necessary or applicable for the purpose aforesaid.

Declaring Land to be vested in the Public Trustee under Section 5 of “The Native Reserves Act Amendment Act, 1895.”

At the Government House, at Wellington, this seventeenth day of February, 1904.

His Excellency the Governor in Council.
WHEREAS by section five of “The Native Reserves Act Amendment Act, 1895” (hereinafter termed “the said Act”), it is enacted that if any question arises whether any land is vested in the Public Trustee under “The Native Reserves Act, 1882,” the Governor may, by Order in Council, declare that such land is so vested: And whereas a question has arisen in respect of the parcel of land set out in the Schedule hereto respecting the vesting of the same respectively in manner aforesaid, and it is expedient to settle any doubt thereon, and to make such declaration in respect of the said land set out in the Schedule hereto:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the land set out in the Schedule hereto is vested in the Public Trustee under and subject to the provisions of “The Native Reserves Act, 1882,” and any Acts read or incorporated therewith.
SCHEDULE.
ALL that parcel of land containing 19 acres 2 roods 29 perches, bounded towards the north-east by the Napier–Wairoa Road, 1407·7 links; towards the south-east by Agricultural Section 16, 272·5 links and 513·6 links, and by Agricultural Section 5, 399·8 links and 601·5 links; again towards the north-east by said Agricultural Section 5 and Rural Section 11, 479·6 links; again towards the south-east by said Rural Section 11, 181·4 links; towards the south-west by said Rural Section 11, 415·5 links; again towards the south-east again towards the south-west by said Rural Section 11;
ERRATUM.—In New Zealand Gazette No. 39, of the 21st May, 1903, page 1208, for “Gerald Arnold Ward,” Tauranga Mounted Rifle Volunteers, read “Gerard Arnold Ward.”
