Amending Regulations for Trout, Perch, and Tench Fishing, Southern Acclimatisation District.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twentieth day of December, 1904.

WHEREAS by an Order in Council dated the twenty-first day of September, one thousand nine hundred and four, and published in the New Zealand Gazette of twenty-second of September then instant, certain regulations were made under “The Fisheries Conservation Act, 1884” (hereinafter termed “the said Act”), providing for trout, perch, and tench fishing within the Southern Acclimatisation District as therein defined: And whereas it is expedient to revoke part of the regulation number one and also regulation number thirteen of the said regulations, together with the Second Schedule thereto, and to make other provision in lieu thereof:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of the powers conferred by the said Act, and of all other powers enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the proviso to regulation number one, also the said regulation number thirteen, and also the Second Schedule to the said regulations, and in lieu thereof doth hereby amend the said regulations as follows:—
In regulation number one of the said regulations substitute the following proviso, namely,—
Provided that it shall be lawful for any secretary or his deputy, in any case where application is made for a license on or after the twentieth day of December in any year, to issue a license to any man for the sum of twelve shillings and sixpence, but so that such license shall extend only from the time of granting the same until the termination of the then trout-fishing season. No license shall confer any right of entry upon the land of any person without his consent.
In lieu of regulation thirteen of the said regulations insert the following, namely,—
- No person shall put, throw, drag, draw, or place, or allow to be put, thrown, dragged, drawn, or placed, for any purpose whatsoever, any net of any description (except a landing-net) in any of the waters, rivers, or streams in the said district in which trout, perch, or tench have been placed or exist, or within half a mile of the mouth or entrance of any such waters, rivers, or streams (except as may be provided in regulations authorising the taking of lake trout): Provided that nothing herein contained shall prevent the placing of any net, other than a stake net, in or across the parts of the rivers mentioned in the Second Schedule hereto for the purpose of taking indigenous fish by such means, or render any person liable to any penalty for so doing.
The following shall be read and substituted as the Second Schedule to the said regulations:—
SECOND SCHEDULE.
The mouth or entrance of the Wairau River to the seaward side of a straight line drawn from a post, painted white, erected upon Section 5 of Square 28, north bank of Wairau, situated in Block XVII., Cloudy Bay Survey District; thence across the River Wairau to a similar post erected upon Section No. 2, Wairau West, Block XVII., Cloudy Bay Survey District; and thence in a straight line across the mouth of the Opawa River to a similar post erected upon part of Section 8, Opawa, of Block I., Clifford Bay Survey District.
The mouth or entrance of the River Waimakariri east of a straight line drawn at right angles to the course of the said river, and across the said river from the eastern corner of Rural Section No. 1393, in the Mandeville Survey District, the said corner of Rural Section No. 1393 being two miles or thereabouts in an easterly direction from the main bridge over the River Waimakariri and the Town of Kaiapoi.
The mouth or entrance of the River Heathcote below the Heathcote Swing-bridge, situate in the main road between Christchurch and Sumner.
The mouth or entrance of the River Avon below the southern end of the island in that river lying opposite Section No. 11212 in the Christchurch Survey District.
The mouth or entrance of the Ashley River, or at any place in such river seaward of a straight line drawn from the southernmost corner of Rural Section No. 716, Rangiora Survey District, on the northern bank of the said Ashley River, thence through the south-easternmost corner of Rural Section No. 23889, Rangiora Survey District, to a point on the southern bank of the said Ashley River.
The mouth or entrance of the Waikouaiti River, or at any place in such river below the place at which the railway from Christchurch to Dunedin crosses the said river.
The mouth or entrance of the Kakanui, Waihemo, and Pleasant Rivers, or at any place in any such rivers not being more than a mile from the mouth or entrance thereof.
The mouth or entrance of the Aparima or Jacob’s River, or at any place in such river below the place at which the Riverton Bridge crosses the said river.

Prohibiting the Bringing of Diseased Potatoes into certain Specified Portions of New Zealand from certain other Portions.—Notice No. 927.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-first day of December, 1904.

THE HONOURABLE SIR J. G. WARD PRESIDING IN COUNCIL.
WHEREAS potatoes within the portion of New Zealand specified in the Second Schedule hereto are affected with early-blight (Alternaria solani) and potato-rot or Irish potato-disease (Phytophthora infestans), being diseases within the meaning of “The Orchard and Garden Pests Act, 1903”; And whereas in the opinion of His Excellency the Governor of the Colony of New Zealand diseased potatoes or potato-plants, or parts thereof, brought from the said portion of New Zealand are likely to spread disease:
Now, therefore, in pursuance and exercise of the powers conferred upon him by the said Act, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby absolutely prohibit the bringing of any potatoes or potato-plants, or any parts of potatoes or of potato-plants, which are affected with disease, into the portion of New Zealand specified in the First Schedule hereto from the portion of New Zealand specified in the Second Schedule hereto.
FIRST SCHEDULE.
PORTION OF NEW ZEALAND INTO WHICH DISEASED POTATOES ETC., ARE PROHIBITED TO BE BROUGHT.
THE Counties of Mangonui, Whangaroa, Hokianga, Bay o Islands, Hobson, Whangarei, Otamatea, Rodney, Raglan. Waikato, Waipa, Coromandel, Thames, Ohinemuri, Piako, Tauranga, Rotorua, Whakatane, Opotiki, Kawhia, Awakino, Waitomo, Clifton, West Taupo, East Taupo, and Waimarino; and the Ports of Gisborne, Port Ahuriri, Napier, Wellington, Wanganui, New Plymouth, Picton, Blenheim, Lyttelton, Timaru, Oamaru, Port Chalmers, Dunedin, Bluff, Greymouth, Westport, and Nelson.
SECOND SCHEDULE.
PORTION OF NEW ZEALAND FROM WHICH DISEASED POTATOES, ETC., ARE PROHIBITED TO BE BROUGHT.
THE Counties of Waitemata, Eden, and Manukau; the City of Auckland; and the Boroughs of Grey Lynn, Parnell, Newmarket, Onehunga, Birkenhead, and Devonport.

of Auckland, to be a Medical Practitioner for the purposes the said Act.
