Act”), it is enacted that if it is found that any land held, taken, purchased, or acquired at any time, under this or any other Act or provincial Ordinance, or otherwise however, for any public work, is not required for such public work, the Governor may, by Order in Council publicly notified and gazetted, cause the same to be sold under the conditions set forth in the said Act:

And whereas a plan has been prepared, and the land described in the Schedule hereto is not now required for the purposes of a public work—that is to say, for road purposes —and it is desirable to sell the same:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance of the powers and authority conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby direct the sale of the land described in the Schedule hereto.

Declaring the Blackbird and Kea additional Injurious Birds under “The Birds Nuisance Act, 1902.”—Notice No. 838.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-seventh day of November, 1903.

Present:

THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred upon him by section two of “The Birds Nuisance Act, 1902,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby declare

The Blackbird (Merula vulgaris),

The Kea (Nestor notabilis),

to be injurious birds within the meaning of the said Act.

IN pursuance and in exercise of the powers vested in him by section one hundred and two of “The Public Works Act, 1894,” as amended by section six of “The Public Works Acts Amendment Act, 1900,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the road or street known as Buckle Street, in the City of Wellington, described in the Schedule hereto (being a road or street constructed by the Governor within the limits of the City of Wellington), shall be under the control and management of the Council of the City of Wellington.

SCHEDULE.

All that road or street in the City of Wellington, commencing from its junction with Taranaki Street and extending in an easterly and southerly direction to the south-western corner of Tory Street and the north-western corner of Banks Terrace, all in the City of Wellington; as the same is more particularly delineated on the plan marked R. 3976, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and coloured sienna thereon.

Fixing Sittings of District Courts.

RANFURLY, Governor.

IN pursuance and exercise of the power and authority in this behalf enabling me, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby fix and appoint that sittings of the District Courts of Ashburton, Timaru and Oamaru, Otago Goldfields, Western Otago, and Westland, for civil and criminal business, shall be held as follows, from and after the first day of January next, in lieu of those previously fixed and appointed:—

ASHBURTON DISTRICT.

In the Courthouse, Ashburton, for civil business only, on 20th January, 9th March, 11th May, 6th July, 7th September, and 8th November.

TIMARU AND OAMARU DISTRICT.

In the Courthouse, Timaru, for civil business only, on 22nd January, 11th March, 13th May, 8th July, and 9th September. For criminal and civil business, on 10th November.

In the Courthouse, Oamaru, for civil business only, on 25th March, 24th May, 23rd September, and 25th November. For criminal and civil business, on 26th January and 19th July.

OTAGO GOLDFIELDS DISTRICT.

In the Courthouse, Lawrence, for civil and criminal business, on 27th May and 22nd November.

In the Courthouse, Queenstown, for civil and criminal business, on 3rd May and 3rd November.

In the Courthouse, Naseby, for civil and criminal business, on 22nd March and 20th September.

WESTERN OTAGO DISTRICT.

In the Courthouse, Invercargill, for civil business only, on 12th January, 15th March, 17th May, 12th July, 13th September, and 15th November.

In the Courthouse, Gore, for civil business only, on 13th January, 15th March, 18th May, 13th July, 14th September, and 15th November.

WESTLAND DISTRICT.

In the Courthouse, Westport, for civil business only, on 7th April, 11th August, and 8th December. For civil and criminal business, on 11th February, 9th June, and 13th October.

In the Courthouse, Greymouth, for civil business only, on 12th April, 15th August, and 12th December. For civil and criminal business, on 16th February, 14th June, and 18th October.

In the Courthouse, Hokitika, for civil business only, on 19th February, 15th April, 19th August, and 21st October. For civil and criminal business, on 17th June and 16th December.

In the Courthouse, Reefton, for civil business only, on the 17th February, 13th April, 15th June, 17th August, 19th October, and 14th December.

In the Courthouse, Kumara, for civil business only, on 20th February, 16th April, 18th June, 20th August, 22nd October, and 17th December.

Provided that in case any of the days so fixed as aforesaid shall happen to be a holiday, then the Court appointed for that day shall be held on the first day thereafter not being a holiday.

As witness the hand of His Excellency the Governor, this fourth day of December, one thousand nine hundred and three.
