Validating Poll of Ratepayers of the Wairoa County Council taken on the 12th Day of November, 1902, under “The Local Bodies’ Loans Act, 1901.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-third day of November, 1903.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section nine of “The Local Bodies’ Loans Act, 1901” (hereinafter called “the said Act”), it is provided that a meeting of the ratepayers to consider the proposal to raise a special loan shall be called by the Chairman by not less than seven clear days’ public notice: And whereas it is provided by section eleven of the said Act that, in taking a poll, a notice shall be published setting forth the day (not being less than one nor more than three weeks from the day of the meeting required by section nine of the said Act) on which the poll shall be taken: And whereas the Wairoa County Council took a poll for the raising of a special loan of eleven thousand three hundred and fifty pounds under the provisions of the said Act: And whereas the meeting of the ratepayers in terms of section nine of the said Act, having been duly called, was held on the fifth day of November, one thousand nine hundred and two: And whereas it was found necessary to take the said poll on the twelfth day of November, one thousand nine hundred and two, being less than one week from the day of the said meeting: And whereas the notice of the said poll was published on the fourth day of November, one thousand nine hundred and two, being the day before the said meeting of ratepayers: And whereas it appears to the Governor that the ratepayers voting for the said loan have not been misled by reason of such irregularity as aforesaid, and it appears expedient to validate the proceedings hereinafter mentioned: And whereas since the taking of the said poll there has been passed “The Local Bodies’ Loans Amendment Act, 1902”: And whereas by section three of the last-mentioned Act every special rate made as security for a loan shall be so calculated as to yield if necessary ten pounds per centum more than the annual or other charges in respect of the loan: And whereas in order to comply with the requirements of said section three of the last-mentioned Act it has been found necessary to reduce the said loan from eleven thousand three hundred and fifty pounds to ten thousand seven hundred and fifty-nine pounds:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the consent of the Executive Council of the said colony, and in pursuance and exercise of the power and authority contained in the tenth section of “The Local Bodies’ Loans Amendment Act, 1902,” doth hereby validate the said poll as a poll authorising a special loan of ten thousand seven hundred and fifty-nine pounds, and doth hereby declare that the proceedings preliminary thereto and consequent thereon shall not be called in question by reason of the irregularity aforesaid.

Declaring Roads through Section 62, Wairaki District, to be Government Roads.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-third day of November, 1903.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1894,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the roads described in the Schedule hereto shall, on and after the date of this Order in Council, be Government roads.
