Powers delegated to the St. Bathan's Domain Board under
"The Public Domains Act, 1881."

RANFURLY, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day
of October, 1903.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers and authorities
vested in him by “The Public Domains Act, 1881,”
His Excellency the Governor of the Colony of New Zealand,
by and with the advice and consent of the Executive
Council thereof, doth hereby revoke a certain Order in
Council, dated the twenty-ninth day of June, one thousand nine hundred and three, making delegation of certain
powers in manner as therein appears; and doth hereby,
with the like advice and consent, and in respect of the land
hereinafter mentioned, delegate all the powers conferred by
the said Act, except the powers conferred by sections five
and twelve thereof, for the period of ten years from the date
hereof (unless previously altered or revoked under the said
Act), to the undermentioned persons, who shall be known as
the St. Bathan's Domain Board, namely,—

William Hanger,
Thomas Wilkinson,
William McConnochie,
William Pyle,
John Ewing,
John Thurlow, and
John Eagle

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business
    on the third Thursday in each month, at half-past seven
    o’clock p.m., at St. Bathan’s, or at such other time or place
    as may from time to time be fixed by the Board. The first
    meeting shall be held on Thursday, the nineteenth day of
    November, one thousand nine hundred and three.

  2. Special meetings may be convened by the Chairman or
    by any two members of the Board, provided that two days’
    notice of such meeting be given to each member, specifying
    the business to be transacted at such special meeting; and
    no other business than that so specified shall be transacted
    at such meeting.

  3. Any three members of the Board shall form a quorum.
    Any meeting may be adjourned from time to time.

  4. The members of the Board shall at their first meeting,
    and thereafter at an annual meeting to be held on the third
    Thursday in January in every succeeding year thereafter,
    elect one of themselves to be Chairman, who may join in the
    discussion, and shall have an original as well as a casting
    vote. The Chairman shall hold office until the election of
    his successor.

  5. The Board shall prepare and submit at each annual
    meeting a report of the proceedings of the Board for the
    previous year ending on the thirty-first day of December,
    together with a statement of the receipts and expenditure
    of the Board for such year. A copy of every such report
    and statement, certified by the Chairman to be correct,
    shall be sent to the Minister of Lands as soon as possible
    after each annual meeting.

  6. If at any meeting the Chairman is not present at the
    time appointed for holding the same, the members present
    shall choose some one of their number to be chairman of
    such meeting.

  7. If, by resignation, death, incapacity, or otherwise, the
    office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a
    Chairman.

  8. All questions shall be determined by the majority of
    votes of the members of the Board present at a meeting.

And with the like advice and consent as aforesaid doth
hereby also order that this delegation shall take effect in
respect of the parcel of Crown land described in the Schedule hereto.

SCHEDULE.

ALL that area in the Otago Land District, containing by
admeasurement 23 acres 1 rood 5 perches, more or less,
being Section No. 25, Block II., St. Bathan’s District.
Bounded towards the north by Crown lands, 1115 and
1080 links; towards the east by Section No. 23 of same
block, 439 and 1032 links; towards the south by Section
No. 26 of same block, 850 links; and towards the west by a
road, 1854 links: be all the aforesaid linkages more or less:
as the same is delineated on the plan deposited in the District Lands and Survey Office, Dunedin.

Changing the Purpose of a Portion of a Reserve in the
Wellington Land District.

RANFURLY, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this tenth day
of October, 1903.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land described in the Schedule hereto
forms part of a reserve heretofore set apart for
cemetery purposes, being a reserve within Class I. of “The
Public Reserves Act, 1881”:

And whereas it is expedient that such land shall be appropriated for municipal purposes, being a reserve within the
said Class I.:

Now, therefore, His Excellency the Governor of the Colony
of New Zealand, acting by and with the advice and consent
of the Executive Council of the said colony, and in exercise
of the powers and authorities vested in him by the fourth
section of “The Public Reserves Act, 1881,” doth hereby
declare that the said land shall, from and after the date
hereof, be appropriated for municipal purposes under
Class I. of “The Public Reserves Act, 1881.”

SCHEDULE.

WELLINGTON LAND DISTRICT.

ALL that parcel of land in the Wellington Land District,
containing by admeasurement 1 acre 1 rood 5 perches, more
or less, being part of Reserve E (formerly part of Reserve L,
Town Belt), Town of Wanganui. Bounded towards the
north by Heads Road; towards the east by a line at right
angles to the last-mentioned boundary, to the southern side
of the said Reserve E; towards the south by Section No. 25,
Town Belt; and towards the west by Lots Nos. 16 and 17 of
Section No. 24, Town Belt: as the same is delineated on
the plan deposited in the office of the Chief Surveyor, Wellington.

Hawera Acclimatisation District defined.

RANFURLY, Governor.

IN exercise and pursuance of the powers and authorities
vested in me by “The Animals Protection Act, 1880,”
I, Uchter John Mark, Earl of Ranfurly, the Governor of
the Colony of New Zealand, do hereby appoint those parts
of the said colony described in the Schedule hereto to be a
district under the said “Animals Protection Act, 1880”;
and I do further appoint such district to be known as the
Hawera Acclimatisation District.

SCHEDULE.

HAWERA ACCLIMATISATION DISTRICT.

THE Counties of Hawera and Patea, together with that
portion of the County of Egmont lying to the eastward of
the Taungatara River, being the Oeo Riding of the said
County of Egmont.

As witness the hand of His Excellency the Governor,
this seventh day of October, one thousand nine
hundred and three.

Removal of Restrictions on Alienation of Native Land.

RANFURLY, Governor.

WHEREAS application has been made to the Governor
by the Native owner of the land described in the
Schedule hereto, praying that the restrictions on the alienation of such land contained in the Land Transfer certificate
of title bearing date the first day of December, one thousand
eight hundred and eighty-seven (Volume xlvi., folio 124), and
now contained in Land Transfer certificate of title dated
the twenty-eighth day of November, one thousand eight
hundred and eighty-nine (Volume liii., folio 197), may be
removed: And whereas inquiry has been duly made by the
Native Land Court, and the said Court has recommended
that such restrictions be removed:

Now, therefore, His Excellency the Governor of the
Colony of New Zealand, in pursuance and exercise of the
powers conferred on him by the fifty-second section of
“The Native Land Court Act, 1894,” and in accordance
with the recommendation of the Native Land Court, doth
hereby order and declare that all restrictions imposed by
the said Land Transfer certificates on the alienation of the
said land are hereby removed.
