Validating Public Notifications re Loan of £1,844 for Construction of a Bridge over the Ashley River, &c., by the Oxford Road Board.

RANFURLY, Governor.
ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twelfth day of May, 1903.

THE HONOURABLE W. C. WALKER PRESIDING IN COUNCIL.

WHEREAS the Oxford Road Board lately proposed to raise a loan of one thousand eight hundred and forty-four pounds for the construction of a bridge over the Ashley River and extension of the Eyre Traffic Bridge:

And whereas a special order making a special rate has been made as the security for the said loan, the public notifications of which are not in accordance with section seventy-five of “The Road Boards Act, 1882,” inasmuch as the special order was not publicly notified once during each of the four weeks immediately preceding the meeting at which such resolution was proposed, though such special order was advertised in three of the said weeks and four notifications appeared: And whereas it is expedient to validate such irregularity:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise and pursuance of the powers and authorities vested in him by section ten of “The Local Bodies’ Loans Amendment Act, 1902,” doth hereby declare that the said irregularity shall be deemed and taken to be as valid to all intents and purposes as though the same were regular in form and in accordance with the provisions of section seventy-five of “The Road Boards Act, 1882.”

Validating certain Declarations made by Mayor and Councillors, Borough of Palmerston North.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-seventh day of May, 1903.

Present:

THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.

WHEREAS by “The Municipal Corporations Act, 1900” (hereinafter called “the said Act”), it is provided that the Mayor shall, before entering upon his office, make and sign in the presence of the Council a declaration in the form in the Second Schedule to the said Act, and that such declaration shall be attested by a Councillor and the Town Clerk: And whereas by the said Act it is also provided that no person shall be capable of acting as Councillor until he has made and signed in the presence of the Mayor or any Councillor and the Clerk a declaration in the form contained in the said Second Schedule to the said Act: And whereas, owing to the unavoidable absence of the former Mayor of the Borough of Palmerston North, the aforesaid declarations of the Councillors of the said Borough of Palmerston North were made and signed in the presence of the Mayor elect of the said borough and the Town Clerk, and thereafter the declaration of the Mayor elect was made in the presence of the Borough Council of the said borough and attested by one of the Councillors and the Town Clerk, such declarations being made on Wednesday, the thirteenth day of May, one thousand nine hundred and three: And whereas it is doubtful whether the aforesaid proceedings were strictly in accordance with the provisions of the said Act, and it is therefore expedient to validate the same:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in exercise and pursuance of the powers and authorities vested in him by the said Act, doth hereby declare that the above-mentioned proceedings and declarations shall be deemed to be valid for the purposes of the said Act.

Fixing Sittings of the District Court at Stratford.

RANFURLY, Governor.

IN pursuance and exercise of the power and authority in this behalf enabling me, I, Uchter John Mark, Earl of Ranfurly, do hereby fix and appoint that sittings of the District Court of Taranaki shall be held as follows, in addition to those previously fixed and appointed:—

In the Courthouse, Stratford: For civil and criminal business, on the fourth Tuesday in February, May, August, and November.

Provided that in case any of the days so fixed as aforesaid shall happen to be a holiday, then the Court appointed for that day shall be held on the first day thereafter not being a holiday.

As witness the hand of His Excellency the Governor, this sixteenth day of May, one thousand nine hundred and three.
