Land taken for a Native School at Kaiwhata.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twentieth day of April, 1903.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required for a certain public work, to wit, a Native school;

And whereas it has been made a condition of the establishment of the said Native school that the site required therefor shall be a free gift from the Native owners to His Majesty the King, and the Native owners have agreed to such condition, and it has been made to appear that such agreement is sufficient for the purposes intended to be effected thereby:

And whereas by a partition order of the Native Land Court, made under the provisions of section thirty-three of “The Native Land Court Act, 1886,” and its amendments, bearing date the twenty-second day of September, one thousand eight hundred and ninety, certain aboriginal natives, as in the said order mentioned, were declared to be the owners of the portion of the Ngapuketurua Native Reserve within which the said land is situated :

And whereas, as required by “The Public Works Act, 1894,” a map has been prepared showing accurately the position and extent of the said land, and such map is hereto attached :

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities conferred by “The Public Works Act, 1894” and “The Public Works Acts Amendment Act, 1900,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and declare that the land shown upon the said map and described in the Schedule hereto is hereby taken for the purposes of the said Native school, and shall vest in His Majesty the King, as from the twenty-first day of May, one thousand nine hundred and three.

Consenting to closing Roads through Lands in Le Bon’s Bay Road District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twentieth day of April, 1903.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section twelve, subsection one, of “The Public Works Acts Amendment Act, 1900,” it is enacted that a local authority shall not declare any county or district road to be stopped, and such road shall not be deemed to be stopped, until the consent thereto of the Governor by Order in Council gazetted is obtained :

And whereas the Le Bon’s Bay Road Board has applied for such consent in respect to the roads described in the Schedule hereto :

Now, therefore, in pursuance and in exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the Le Bon’s Bay Road Board closing the parts of the roads mentioned in the Schedule hereto.

Powers delegated to the Millerton Domain Board under “The Public Domains Act, 1881.”

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twentieth day of April, 1903.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the twelfth day of March, one thousand nine hundred and one, making delegation of certain powers in manner as therein appears; and doth hereby, with the like advice and consent, and in respect of the land hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the undermentioned persons, who shall be known as the Millerton Domain Board, namely,—

WILLIAM HENRY ROONEY,
JOHN MENNIE STEWART,
JAMES FLETCHER,
WATSON WHITWELL, and
WILLIAM MOORE

(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

  1. The Board shall meet for the transaction of business on the third Monday in each month, at half-past seven o’clock p.m., at the schoolhouse, Millerton, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the eighteenth day of May, one thousand nine hundred and three.

  2. Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  3. Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  4. The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the third Monday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  5. The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.
