NATIVE LAND COURT NOTICES.

Order under Section 39 of “The Native Land Court Act, 1894.”

IN THE NATIVE LAND COURT OF NEW ZEALAND.

In the matter of the succession to Kapo te Tou, deceased, in Waitarere, and of the application of Poni Hakaria under section 39 of “The Native Land Court Act, 1894.”

WHEREAS the above application was referred by me to the Native Land Court for inquiry and report, and the same has been duly reported on: And whereas the Court, by its order made on the 14th day of May, 1887, appointed Mihaka Karepa, Epiha Karepa, and Heni te Rei to succeed to the interest of the said Kapo in Waitarere: And whereas the Court made the succession order in the belief that there were no living descendants of the said Kapo other than Karepa Kapukai and his children, the said Mihaka Karepa and Epiha Karepa: And whereas it was shown upon the said inquiry that there was another descendant of the said Kapo living at his decease—viz., Pango Akuhata, daughter of Akuhata Karanama, deceased: And whereas by reason of the said want of knowledge on the part of the Court the said Pango Akuhata was erroneously omitted from the said succession order:

Now, therefore, for the purpose of rectifying the said omission, and in exercise of the power in that behalf vested in me as Chief Judge of the Native Land Court by section 39 aforesaid, I hereby order that the said succession order of the 14th day of May, 1887, be amended by adding the name of the said Pango Akuhata as the owner of one-half of the said interest, the other half to be for the said Mihaka Karepa, Epiha Karepa, and Heni te Rei equally between them: And, further, that the partition order for Waitarere No. 6, so far as relates to the successors of the said Kapo, be amended to correspond with the amended succession order: Provided that the order hereby made shall in nowise affect the title of the lessees under a certain lease of Waitarere No. 6, granted by the said Karepa Kapukai and others to Thomas Kenny and others for twenty-one years from the 1st day of September, 1897; but the person whose name is hereby ordered to be included in the title, or her duly appointed successors, shall be entitled to share in the rent payable under the said lease as from the date hereof in the proportion above indicated.

NOTICE is hereby given that application has been made to the Court for a certificate under section 55 of “The Native Land Court Act, 1894,” confirming the alienation hereunder specified. All objections to the granting of such certificate must be lodged with me within fourteen days from the publication of this notice.

WHEREAS by Order in Council dated the 29th day of November, 1902, and issued under the provisions of section 14 of “The Native and Maori Land Laws Amendment Act, 1902,” jurisdiction is conferred on the Native Land Court to inquire into and determine all questions in dispute as to the boundaries of the Huatau Block—otherwise known as Odeland’s Land Claims—in the Hokianga County, and to adjudicate upon as Native land any land now in possession of or claimed by the Crown which the Court shall find ought not to have been included in the Crown grant to James Scott Odeland of the said land:

Now, notice is hereby given that inquiry into the said matter will be completed by the ascertainment of the Native owners of the said land, and their relative shares or interests therein, at a sitting of the Native Land Court at Rawene on the 18th day of April, 1903. All persons interested are hereby notified to attend at the time and place aforesaid.
