  1. The rentals stated above shall be the prices at which the lands shall be open for selection.

  2. Applications for leases shall be made in manner as provided in Part I. of the said Act; and all such applications shall be made to the Commissioner of Crown Lands, Wellington; and leases will be issued in accordance with the provisions of Part I. aforesaid.

  3. Each applicant shall state his or her residence, occupation, and condition in life (namely, whether married or single), and will be required to make the declaration prescribed in Schedule C of the said Act.

  4. The successful applicants shall pay the first half-year’s rent, together with the lease and registration fee, and the valuation of the improvements (if any), immediately the application has been approved or declared successful at the ballot.

  5. All rents must be paid half-yearly, in advance, on the 1st days of January and July in each year, as provided in section 157 of the said Act; and the first half-year’s rent is payable as before provided.

  6. Improvements and residence on the land comprised in each lease shall be as provided in Part III. of the said Act. The provisions of section 144, and all other provisions of the said Act with respect to substantial improvements, shall apply accordingly to lessees under these regulations. The provisions of section 141, and all other provisions of the said Act in respect of compulsory residence, shall apply accordingly to lessees under these regulations.

  7. No lessee shall subdivide, sublet, or transfer the land held by him under these regulations, except under and subject to the provisions of Part I. of the said Act.

  8. No lessee shall hold more than one allotment, and such allotments shall be held for his or her sole use and benefit, and not for the use or benefit of any other person whomsoever. No married woman shall be eligible as a selector; but this provision shall not apply to any married woman who may become a transferee under a will or by virtue of an intestacy.

  9. All the provisions of the said Act, so far as applicable, shall extend and apply to the lands affected by these regulations, and to the applications and leases to be made and issued thereunder, and generally to the interests created, and the persons whose rights, liabilities, or interests are thereby affected; and the mention of any particular provision of the said Act shall not be deemed to exclude any other provision of the said Act applicable to the particular case.

Declaring Government Roads in Hatuma Estate to be District Roads.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this nineteenth day of March, 1903.

Present:

His Excellency the Governor in Council.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1894,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the roads described in the Schedule hereto shall, on and after the date of this Order in Council, be district roads.

SCHEDULE.

The road known as Waiau Road, commencing at the point where it junctions with Hatuma Road, at the eastern boundary of Sections 5 and 11, Block I., Motuotaria Survey District, and ending at the point where it junctions with Maharaeke Road, between Sections 2 and 6, Block I., Motuotaria Survey District.

The road known as Maharaeke Road, commencing at the north-west corner of Section 3, Block XIII., Waipukurau Survey District, being the point where it junctions with the Main South Road, and ending at its junction with Makotukutuku Road, at the south-west boundary of Section 1, Block IV., Takapau Survey District.

The road giving access from Hatuma Road to Hatuma Lake Reserve, and constituting the north-east boundary of Section 1, Block II., Motuotaria Survey District.

The road through Hatuma Township, commencing at its junction with Hatuma Road, and running in a westerly direction to the eastern boundary of Section 13, Block I., Motuotaria Survey District.

The road through Section 2, Block I., Motuotaria Survey District, commencing at its junction with Maharaeke Road, and running in a north-westerly direction to the north-west boundary of the aforesaid section.

That portion of the road known as Makotukutuku Road, commencing at Ngahape Stream, on the eastern boundary of Section 1, Block I., Motuotaria Survey District, to its junction with Hatuma Road, at the western boundary of the aforesaid section.

The road known as Rangitoto Road, commencing at its junction with Makotukutuku Road, at the north-west corner of Section 1, Block V., Motuotaria Survey District, and ending at the western boundary of Section 9, Block VIII., Takapau Survey District.

The road known as Ngahape Road, commencing at its junction with Hatuma and Makotukutuku Roads, on the northern boundary of Section 1, Block I., Motuotaria Survey District, and ending at the north-east boundary of S.G.R. No. 7, Block VIII., Takapau Survey District.

The road giving access to S.G.R. No. 6, commencing at its junction with Rangitoto Road, at the north-east corner of Section 4, and running in a southerly direction to the northern extremity of S.G.R. No. 6; the whole of the road being in Block VIII., Takapau Survey District.

The road known as Turiri Road, commencing at the eastern boundary and ending at the western boundary of Section 1, Block XII., Takapau Survey District.

The road known as Purimu Road, commencing at the eastern boundary and ending at the western boundary of Section 2, Block XII., Takapau Survey District.

The road commencing at the south-eastern boundary and ending at the north-western boundary of Section 1, Block XI., Takapau Survey District, and also the road intersecting it, and running in a southerly direction to the point where it junctions with the Ormondville Road, in Block XI., Takapau Survey District.

All in the Hawke’s Bay Land District; as the above-mentioned roads are more particularly delineated on the plan marked R. 2323B, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured red.
