districts, and the Governor is of opinion that it is equitable
that the latter district should contribute towards the cost of
constructing or maintaining the whole or any portion of
such road in the former district, the Governor may from
time to time apportion the cost of constructing or maintain-
ing the whole or any part of such road among the local
authorities of the respective districts as he thinks fit: And
whereas the road described in the First Schedule hereto is a
county road within the County of Ohinemuri, and is largely
used for the purposes of traffic to or from the Borough of
Waihi and affords access to and from the said borough:
And whereas the Governor is of opinion that the cost of
maintaining the said road should be apportioned between
the respective local authorities of the said county and
borough, as hereinafter appears:
Now, therefore, I, Uchter John Mark, Earl of Ranfurly,
Governor of the Colony of New Zealand, in pursuance and
in exercise of the power and authority vested in me by the
said Act, and of all other powers enabling me in this behalf,
do hereby proclaim and declare as follows, that is to say,—
- The said road shall be maintained in good order and
condition by the Council of the County of Ohinemuri (here-
inafter called “the County Council”), and the cost of
maintenance shall be apportioned between the County
Council and the Council of the Borough of Waihi (herein-
after called “the Borough Council”) in the manner and
subject to the provisions hereinafter specified. - The Borough Council shall forthwith pay to the
County Council two-thirds of the total cost of maintenance
actually expended by the County Council between the
first day of March, one thousand nine hundred and two,
and the first day of November, one thousand nine hundred
and two (both days inclusive), upon being supplied by the
County Council with satisfactory proof of the amount so
expended. - From and after the first day of November, one thousand
nine hundred and two, the Borough Council shall pay to
the County Council two-thirds of the total cost of main-
tenance actually expended by the County Council: Provided
that the total liability of the Borough Council under this
clause during any one year, computed from the first day of
November, one thousand nine hundred and two, shall not
exceed three thousand five hundred pounds in respect of
such portion of the said road as is described in the Second
Schedule hereto, and eight hundred and thirty-four pounds
in respect of the residue of the said road (being the portion
described in the Third Schedule hereto). - All cost of maintenance heretofore expended or in-
curred by the County Council and by the Borough Council
respectively, under clause (b) of a certain agreement be-
tween them, dated the thirty-first day of October, one
thousand nine hundred and two, shall be taken into account
in computing the liability of the Borough Council under
this Proclamation. - The contribution to be made by the Borough Council
under this Proclamation shall be paid from time to time to
the County Council within thirty days after demand in
writing by or on behalf of the County Council. - As often as any question or dispute arises as to the
amount payable by the Borough Council under any such
demand, the same shall be settled by arbitration; but,
pending the result of the arbitration, the Borough Council
shall pay in accordance with the demand, and deduct any
excess from future contributions.
FIRST SCHEDULE.
DESCRIPTION OF ROAD.
That portion of the Main County Road extending from the
Puke and Junction Landings on the Waihou River in an
easterly direction to the western boundary of the Borough
of Waihi, and from the south-eastern boundary of the
Borough of Waihi to the boundary between the Ohinemuri
and the Tauranga Counties; as the said road is more
particularly delineated on the plan marked R. 4677, de-
posited in the office of the Chief Engineer of Roads, at
Wellington, in the Wellington Land District, and thereon
coloured red and blue.
SECOND SCHEDULE.
PORTION OF THE AFORESAID ROAD IN RESPECT WHEREOF THE
ANNUAL LIABILITY OF THE BOROUGH COUNCIL IS NOT TO
EXCEED £3,500.
That portion extending from the Puke and Junction
Landings to the eight-mile peg at the foot of Earl’s Hill,
near Waikino Township, in the County of Ohinemuri; as
the same is more particularly delineated, and coloured red
on aforesaid plan marked R. 4677.
THIRD SCHEDULE.
RESIDUE OF AFORESAID ROAD, IN RESPECT WHEREOF THE
ANNUAL LIABILITY OF THE BOROUGH COUNCIL IS NOT TO
EXCEED £834.
That portion extending from the aforesaid eight-mile peg
to the western boundary of the Borough of Waihi, and also
that portion extending from the south-eastern boundary of
the Borough of Waihi to the boundary between the Ohine-
muri and Tauranga Counties; as the said two portions are
more particularly delineated, and coloured blue on the
aforesaid plan marked R. 4677.

Knight Grand Cross of the Most Distinguished
Order of Saint Michael and Saint George;
Governor and Commander-in-Chief in and over
His Majesty’s Colony of New Zealand and its
Dependencies; and issued under the Seal of the
said Colony, at the Government House, at Wel-
ington, this sixteenth day of March, in the year
of our Lord one thousand nine hundred and
three.

ORDER IN COUNCIL.
At the Government House, at Wellington, this sixteenth
day of March, 1903.

His Excellency the Governor in Council.
IN pursuance and exercise of the power and authority
vested in him by “The Government Valuation of
Land Act Amendment Act, 1900,” His Excellency the
Governor of the Colony of New Zealand, acting by and
with the advice and consent of the Executive Council of
the said colony, doth hereby order and direct that the dis-
trict valuation rolls for the special districts enumerated in
the Schedule hereto shall be revised by the Valuer-General
as at the thirty-first day of March, one thousand nine hun-
dred and three.
