Regulations under “The Civil Service Insurance Act, 1893.”
RANFURLY, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-sixth day of July, 1902.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by an Order in Council bearing date the eighth day of March, one thousand eight hundred and ninety-four, His Excellency the Governor of the Colony of New Zealand did, in exercise and pursuance of the powers vested in him by “The Civil Service Insurance Act, 1893” (hereinafter referred to as “the said Act”), approve of the rules and regulations contained in the said Order in Council: And whereas it is expedient to revoke the said rules and regulations, and to substitute others in lieu thereof:
Now, therefore, His said Excellency, in exercise and pursuance of the powers and authorities vested in him by the said Act, and of all other powers and authorities in this behalf vested in him, and by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the rules and regulations contained in the said Order in Council, and in lieu thereof doth hereby make and prescribe the regulations set forth hereunder: Provided that such revocation shall not be deemed to alter or affect any contract, act, matter, or thing which shall be or has been duly made or done in accordance with and subject to such revoked rules and regulations. And, in further exercise and pursuance of the powers and authorities aforesaid, and by and with the like advice and consent as aforesaid, His said Excellency doth order and direct that the several tables set forth in the Schedules hereto shall be the tables to be used for the purposes of the said Act, until other provision shall be lawfully made in that behalf. And, lastly, in exercise and pursuance of the powers and authorities aforesaid, and by and with the like advice and consent as aforesaid, His said Excellency doth hereby order and direct that this present Order in Council shall take effect on and after the first day of January, one thousand nine hundred and three.
REGULATIONS.
- In these regulations, and in all policies or instruments issued or made thereunder, if not inconsistent with the context,—
“Commissioner” means the Government Insurance Commissioner holding office for the time being:
“Officer” means any person (not exempted by the said Act) employed in any permanent capacity in the public service, and paid an annual salary out of the public moneys.

From the salary of every officer hereafter appointed whose age does not exceed forty years, nearest birthday, at date of appointment there shall be deducted monthly a sum of money, according to the rate of his salary, as set forth in the First Schedule hereto, and every such officer shall be entitled to the issue by the Commissioner of a policy conferring the combined insurance and annuity benefits prescribed in the Second Schedule hereto.

Every such officer may, by special application to the Commissioner prior to the issue of his policy, have a provision inserted therein stipulating for the continuance of the insurance (including any additions thereto effected in accordance with No. 5 of these regulations) after age sixty, in consideration of the payment to the Commissioner of the equivalent additional deductions from his salary necessary from time to time according to the rates prescribed in the Third Schedule hereto.

From the salary of every officer hereafter appointed whose age exceeds forty years, nearest birthday, at date of appointment, and who shall within three months of date of appointment elect to take out a policy in accordance with subsection (2) of section 10 of the said Act, there shall be deducted a monthly sum of the amount prescribed in the First Schedule hereto; and every such officer shall be entitled to the issue by the Commissioner of a policy in accordance with any of the gazetted tables of the Government Life Insurance Department: Provided that the officer shall pass any medical examination which may be necessary for the satisfaction of the Commissioner.

The monthly deduction from the salary of every officer taking out a policy under the said Act shall be increased in accordance with the First Schedule hereto whenever an increase to the salary of such officer shall bring the salary actually paid to such officer into the next higher rate of salary, as shown in the First Schedule hereto; and the Commissioner shall effect an indorsement upon the policy, stating the increase in the monthly deduction, and the corresponding increase in the benefit or benefits, which shall be calculated for the age of the officer at the date upon which such increased deduction takes effect, in accordance with the Second Schedule or the Second and Third Schedules hereto if the date of the policy be on or after the first day of January, one thousand nine hundred and three, and in accordance with the Fourth Schedule or the Fourth and Fifth Schedules hereto if the date of the policy be earlier than the first day of January, one thousand nine hundred and three.

In all cases in which an increase in the deduction from the salary of any officer is due, as mentioned in Regulation No. 5, the time when such increase shall commence shall be the first monthly date for payment of salaries which shall occur after such increased salary has been approved by the proper authority; and the date from which the Commissioner shall become liable in respect of the increased benefits corresponding to such increased deductions shall be the date upon which the first of such increased deductions is actually paid to the Commissioner.

Every officer taking out a policy with the department under the said Act shall furnish such information as to date of birth, and fill up such application and other forms, as may be required by the Commissioner.

All rules and regulations framed under the Acts in force relating to the Government Life Insurance Department shall, mutatis mutandis, apply to policies issued under these regulations, provided they do not conflict or are not inconsistent therewith.
