Amended Description of the Arrow River and Tributaries as a Watercourse under Section 111 of “The Mining Act, 1898.”

A PROCLAMATION.
WHEREAS a notice dated the eleventh day of April, one thousand nine hundred and one, was published in Gazette No. 38, of the eighteenth day of April then instant, wherein it was notified that application had been made to the Governor to constitute and set apart the watercourses the names, localities, and descriptions of which were set out in the Schedule thereto to be watercourses for the purposes therein mentioned:
And whereas amongst the watercourses named in the said Schedule was the Arrow River and certain of its tributaries, described in the Schedule hereto:
And whereas by Proclamation dated the eighteenth day of December, one thousand nine hundred and one, published in Gazette No. 10, of sixth day of February, one thousand nine hundred and two, the Arrow River with its tributaries was constituted and set apart as a watercourse for the purposes mentioned in the said Proclamation:
And whereas the description of the Arrow River and its tributaries in the Schedule to the Proclamation last aforesaid is incorrect, not being in conformity with the notice gazetted on the eighteenth day of April, one thousand nine hundred and one, aforesaid:
And whereas it is expedient to amend the said Proclamation and the description of the aforesaid river and its tributaries in manner hereinafter set forth, in accordance with the Gazette notice aforesaid:
Now, therefore, His Excellency Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise of the powers conferred by “The Mining Act, 1898,” and of all other powers enabling him in that behalf, doth hereby amend the description of the Arrow River and its tributaries as set forth in the Proclamation aforesaid, and in lieu thereof doth hereby constitute and set apart the watercourse described in the Schedule hereto to be a watercourse into which may be discharged any tailings, débris, and waste water produced by or resulting from mining operations carried on under the said Acts, and in which, or on the banks of which, mining operations may be lawfully carried on, and doth hereby further prescribe that this Proclamation shall take effect on and after the thirty-first day of May, one thousand nine hundred and two.
SCHEDULE.
That river known as the Arrow River, in the Lake County, which flows southerly from its source near Mount Hyde for a distance of about twenty miles to its confluence with the Kawarau River, together with its tributaries north of Arrowtown.
Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this eleventh day of April, in the year of our Lord one thousand nine hundred and two.

IN pursuance and exercise of the powers and authorities vested in him by “The Urewera District Native Reserve Act, 1896,” and “The Urewera District Native Reserve Act Amendment Act, 1900,” and of every other power and authority in that behalf enabling him, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby appoint

to be a Commissioner for the purposes of the said Acts, vice David Scannell, Esq., resigned.

Setting apart a Reserve under “The Kauri-gum Industry Act, 1898.”

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this ninth day of April, 1902.

THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.
WHEREAS by “The Kauri-gum Industry Act, 1898” (hereinafter termed “the said Act”), it is enacted that the Governor in Council is authorised under the said Act to set apart any specified area of Crown lands within a kauri-gum district to be a kauri-gum reserve under the said Act:
And whereas it is expedient to create and set apart the kauri-gum reserve hereinafter mentioned:
Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in pursuance of the power and authority conferred upon me by the said Act, and acting by and with the advice and consent of the Executive Council of the said colony, do hereby set apart the area of Crown land described in the Schedule hereto as a kauri-gum reserve, with the name set over the description of such reserve in the said Schedule.
SCHEDULE.
BAY OF ISLANDS COUNTY.
Towai Kauri-gum Reserve: 52 acres 2 roods. For Towai Settlement.
Towai Kauri-gum Reserve.
All that area in the Auckland Land District, being the eastern portion of Section No. 6 of Block I., Hukerenui Survey District, containing by admeasurement 52 acres 2 roods, more or less. Bounded towards the north-east by Section No. 5 of Block I., Hukerenui Survey District; towards the east by a public road; towards the south by the Towai No. 1 Kauri-gum Reserve, proclaimed in Gazette of 13th April, 1899, page 756; and towards the west by the western portion of Section No. 6 of Block I. aforesaid to the point of commencement.

WHEREAS by section fifteen of “The Native Land Court Act, 1894,” it is provided that the Governor in Council may by Order from time to time confer upon the Native Land Court jurisdiction in any matter or question referred to in such Order exclusively affecting the rights of Natives in any real or personal property: And whereas the title to the Whakateremanawa-Kaiaia Block, in the Hokianga District, containing eleven thousand eight hundred and twenty-eight acres, more or less, was investigated by the Native Land Court in the year one thousand eight hundred and sixty-seven, and a certificate of title issued for the same in favour of the Native tribe or hapu called Te Mahurihuri: And whereas it is desirable that the said Court should be empowered to inquire and determine who are the members of the said tribe or hapu, and what are their respective interests in the said block, and to make order accordingly:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in exercise of the hereinbefore-recited power and authority, and of every other power and authority enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby confer on the Native Land Court full power and jurisdiction to inquire into and determine the several matters aforesaid, and any matter or question which may arise in relation thereto, and to make such order or orders therein as shall, in the opinion of the said Court, be necessary or expedient.
