Powers delegated to the Utiku Domain Board under “The Public Domains Act, 1881.”
RANFURLY, Governor.
ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this tenth day of February, 1902.
Present:
THE HONOURABLE SIR J. G. WARD PRESIDING IN COUNCIL.
WHEREAS by the twelfth section of “The Public Domains Act, 1881,” it is, inter alia, enacted that the Governor, by Order in Council, may from time to time delegate all or any of the powers by the said Act conferred, save as is therein mentioned, to any person or persons, for any period, and subject to such stipulations as may be specified in such Order, and that every such delegation may from time to time in like manner be altered or revoked: And whereas, pursuant to “The Public Reserves Act, 1881,” by an Order in Council of even date herewith, the land described in the Schedule hereto, situate in the Wellington Land District, is declared to be brought under the operation of and to be subject to the provisions of the said “Public Domains Act, 1881”:
Now, therefore, His Excellency the Governor, by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth hereby, and in respect of the land hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the under-mentioned persons, who shall be known as the Utiku Domain Board, namely,—
FREDERICK DAVID LUKS, storekeeper;
JAMES GRACE, bushman;
FREDERICK WILLIAM TYSON, benchman;
JAMES MAYNE, machinist; and
HERBERT NORMAN THEOBALD, labourer;
all of Utiku (herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

The Board shall meet for the transaction of business on the first Monday in the months of January, April, July, and October, at eight o’clock p.m., at the Schoolhouse, Utiku, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the seventh day of April, one thousand nine hundred and two.

Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the second Monday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

If, by resignation, death, incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any quarterly or special meeting appoint a Chairman.

All questions shall be determined by the majority of votes of the members of the Board present at a meeting.
And with the like advice and consent as aforesaid doth hereby also order that this delegation shall take effect in respect of the parcel of Crown land described in the Schedule hereto.
SCHEDULE.
ALL that parcel of land in the Wellington Land District, containing by admeasurement 5 acres and 11 perches, more or less, being Sections Nos. 4 and 5, Block I., Potaka Township: as the same is delineated on the plan deposited in the District Lands and Survey Office, Wellington.

BY virtue of the powers and authorities vested in me by the twenty-fourth section of “The Public Reserves Act, 1881,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, do hereby order and declare that the reserve made for public recreation in the Wellington Land District, described in the Schedule hereto, shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of “The Public Domains Act, 1881”; and such domain shall hereafter be managed, administered, and dealt with in manner directed by the said Act.
SCHEDULE.

Revoking Order in Council licensing Roderick McIntosh to occupy a Part of Foreshore in Whangaroa Harbour.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this tenth day of February, 1902.

THE HONOURABLE SIR J. G. WARD PRESIDING IN COUNCIL.
WHEREAS by Order in Council dated the thirteenth day of August, one thousand nine hundred, and published in the New Zealand Gazette No. 72, of the sixteenth day of the same month, His Excellency the Governor in Council did, in pursuance of the provisions of “The Harbours Act Amendment Act, 1883,” amongst other things, license Roderick McIntosh, of Whangaroa, to use and occupy parts of the foreshore of Whangaroa Harbour, in the Provincial District of Auckland, for the purpose of erecting and maintaining thereon a store-room in the position shown on, and in accordance with, plan marked M.D. 2294, and deposited in the office of the Marine Department at Wellington:
And whereas the said Roderick McIntosh has ceased to occupy the portion of the foreshore to which the said license to him applies, and desires that the said license to him should be revoked:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of all the powers enabling him in that behalf, doth hereby revoke and determine the said recited Order in Council, and every right, power, and privilege conferred thereby or intended so to be, in so far as relates to the said Roderick McIntosh.

Fixing Shooting-season for Deer, License-fee, &c., Marlborough District.

IN exercise of the powers vested in me by “The Animals Protection Act, 1880,” and the Acts amending the same, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby notify that red-deer stags and fallow-deer bucks may be taken or killed within the Marlborough District, comprising the Counties of Marlborough and Sounds, from the twenty-second day of February, one thousand nine hundred and two, to the twenty-first day of April, one thousand nine hundred and two, both inclusive (subject, nevertheless, to the restrictions in the said Acts mentioned); and I do further notify that licenses to take or kill such game within the said district shall be issued on the payment of the sum of twenty
