Notice of Vesting of Land in the Public Trustee under “The Unclaimed Lands Act, 1894.”

WHEREAS I, the undersigned, the Public Trustee, have, for the purposes of “The Unclaimed Lands Act, 1894,” made due inquiries with respect to the land described in the Schedule hereunder written, and the owner thereof, and have, in respect of the said land, given the notices prescribed by section 4 of the said Act, and have in all respects complied with the provisions of the said section: And whereas I have not thereby ascertained who the owner is, and believe that such owner is not in the colony, nor has such owner established his title to the said land, as required by the said Act: I hereby give notice that the said land is, under and by virtue of the said Act, vested in me, as the Public Trustee as aforesaid, as from the date of the publication hereof, and will be administered under the said Act, the assessed value of the said land being less than £100.

Dated at Wellington, this 5th day of October, 1901.

SCHEDULE.

Notice by the Public Trustee under “The Unclaimed Lands Act, 1894.”

WHEREAS the title to 390 acres of land, being Section 79 in the Parish of Pukiri and Provincial District of Auckland, is, according to the Crown grant thereof, vested in six persons as tenants in common, of whom two are described as follows—namely, Felix Choisey, a tailor, of Auckland, and John Hill Carter, a settler, of Auckland: And whereas the other four owners are persons known and to be found: And whereas it is confidently reported to me, the Public Trustee, that the said Felix Choisey died beyond the colony many years ago, and it is likewise reported the said John Hill Carter left the colony a great many years ago, and has never since been heard of: And whereas I have instituted inquiries, and have not thereby ascertained who the owners or owner of the said two undivided shares or interests, or either of them, before mentioned, in the above-described land are or is, and believe that such owners are not in the colony:

Now, this notice calls upon such owners or owner, within six months of the date of the publication of this notice in this Gazette, to establish to the satisfaction of the Public Trustee their or his title to the respective shares or interests held by them, or either of them, in the land specified in this notice; and, if such owners, or either of them, do not, within the time limited, so establish their title respectively, the Public Trustee will exercise the powers and authorities granted to him in and by “The Unclaimed Lands Act, 1894,” in respect of both, or either, the said shares or interests, as may then be required.
