Increasing the Holding-area of Land to Settlers in the Waikawa Village Settlement, Southland.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this eighteenth day of November, 1901.
Present:
THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.
WHEREAS by an Order in Council issued on the fifteenth day of June, one thousand eight hundred and ninety-three, under the authority of the one-hundred-and-sixty-ninth section of “The Land Act, 1892,” fixing the terms and conditions upon which certain village-settlement lands therein enumerated should be disposed of, it was provided that no lessee should hold more than fifty acres in the Waikawa Village Settlement:
And whereas it is expedient to increase the area that may be held by one person in the Waikawa Village Settlement to seventy acres:
Now, therefore, His Excellency the Governor, in pursuance of all powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth hereby amend the Order in Council aforesaid so far as it affects the areas in which the land in the Waikawa Village Settlement shall be held, and doth by this present Order declare that on and after the date hereof any settler may apply for and acquire land therein of an area not exceeding seventy acres in extent in the whole; and it is hereby further declared that all the provisions of the Order in Council of the fifteenth day of June, one thousand eight hundred and ninety-three, aforesaid, shall apply, except as regards the area in which the sections may be held, to the Waikawa Village Settlement aforesaid.

Declaring Toritea-Makuri Road, in the Makuri Survey District, to be a County Road.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1894,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby order that the portion of the Toritea-Makuri Road described in the Schedule hereto, and which was made by the Governor under powers contained in “The Public Works Act, 1894.” and has hitherto been a Government road, shall, on and after the date of this Order in Council, become a county road.
SCHEDULE.
TORITEA-MAKURI ROAD.
That portion of the Toritea-Makuri Road, situated in the Makuri Survey District, Land District of Wellington, which commences at a point on the western boundary of the Makuri Township Reserve, and follows thence generally the course of the Makuri River to its junction with the Tiraumea River; thence eastwards to where it crosses the said river; thence proceeding from that crossing in a westerly direction to its junction with the Mangaramarama Road; thence to the Masterton Road: as the said road is delineated upon the plan marked R. 944, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured yellow.

Consenting to closing Road in Block VI., Mangahao Survey District, County of Pahiatua.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this eighteenth day of November, 1901.

WHEREAS by section twelve, subsection one, of “The Public Works Acts Amendment Act, 1900,” it is enacted that a local authority shall not declare any county or district road to be stopped, and such road shall not be deemed to be stopped, until the consent thereto of the Governor by Order in Council gazetted is obtained: And whereas the County Council of Pahiatua has applied for such consent in respect of the road described in the Schedule hereto:
Now, therefore, in pursuance and in exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby consent to the County Council of Pahiatua closing the part of the road mentioned in the Schedule hereto.

Approving of Plans of Harbour-works at Nelson.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-eighth day of November, 1901.

THE HONOURABLE W. C. WALKER, C.M.G., PRESIDING IN COUNCIL.
WHEREAS it is provided by section one hundred and fifty-six of “The Harbours Act, 1878” (hereinafter called “the said Act”), that before any Harbour Board or any other body or person shall commence to make, construct, or erect any harbour-works or other structure of any kind on, in, over, through, or across tidal lands, or a tidal water or seashore below low-water mark, or in the bed or bottom of any port or harbour, such body or person shall, before commencing the making or construction of the work, deposit at the office of the Marine Department a plan in duplicate of the whole work, showing details of the proposed work, and the mode in which it is proposed the same shall be carried out:
And whereas it is also provided by the hereinbefore-recited section of the said Act that if it appears to the Governor in Council that the proposed work will not be or tend to the injury of navigation the Governor in Council may approve of the deposited plan, with or without modification or addition, and subject or not to any restriction or condition necessary for the preservation of any public right:
And whereas the Nelson Harbour Board has deposited at the office of the Marine Department a plan (consisting of three sheets) in duplicate, marked M.D. 2484, of harbour-works which the Board propose to carry out in the port or harbour of Nelson:
And whereas it is desirable that the said plan should be approved by the Governor in Council, subject to certain modifications and conditions:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the hereinbefore-recited power and authority, and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby approve of the said plan (three sheets), marked M.D. 2484, of harbour-works which the Nelson Harbour Board propose to carry out in the port or harbour of Nelson, subject to the following modifications and conditions, viz. :—

The boulder stop-bank shown on the plan across the present channel, between Haulashore Island and Haven Road, shall not be constructed.

The inner end of the south mole shall not extend into deep water at the east side of the Boulder Bank, but shall terminate at the point where it is met by the yellow line on the plan, and such yellow line shall form the eastern boundary of the reclamation which is to be made with dredgings spoil.

The issue of an advertisement inviting tenders for the work, or any part thereof, shall be deemed to be an acceptance by the Board of the conditions of this Order in Council.
