Allocating Lands reserved and taken for a Railway to the Purposes of a Street in the Town of Waitara.

A PROCLAMATION.

WHEREAS the lands mentioned in the Schedule hereto form part of land taken for the purposes of the Foxton-New Plymouth Railway, Sentry Hill to Waitara Branch, and it is considered desirable to allocate such lands to the purposes of a street:

And whereas it has been certified by the Minister for Railways that such lands are not required for railway purposes: And whereas such lands are situated in the Town of Waitara, the local authority of which has consented to the issue of this Proclamation:

And whereas His Excellency the Governor is of opinion that the said local authority can conveniently construct and maintain the said street:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities in me vested by section one hundred and seventy-seven of “The Public Works Act, 1894,” and of every other power and authority in anywise enabling me in that behalf, do hereby proclaim and declare that the lands described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a street, and that the said street shall be under the control of the Raleigh Town Board, and shall be maintained by the said Town Board in like manner as other public highways are controlled and maintained by the said Town Board.

SCHEDULE.

ALL that area in the Taranaki Land District, in the Waitara Survey District, containing 1 rood 24 perches, more or less, being portions of Sections 3 and 4, in Block LXXXVIII., in the Town of Waitara. Bounded on the north-east by Domett Street, 100 links; on the south-west by Grey Street, 100 links; on the south-east by Sections 5 and 6 in said Block LXXXVIII.; and on the north-west by a line parallel to, and 100 links distant from, the last-described boundary.

Also, all that area in the Taranaki Land District, in the Waitara Survey District, containing 1 rood 24 perches, more or less, being portions of Sections 3 and 4, in Block LXXXIX., in the Town of Waitara. Bounded on the north-east by Queen Street, 100 links; on the south-west by Domett Street, 100 links; on the south-east by Sections 5 and 6 in said Block LXXXIX.; and on the north-west by a line parallel to, and 100 links distant from, last-described boundary: as the said parcels of land are more particularly delineated on the plan marked 10619, deposited in the office of the Minister for Railways, at Wellington, and thereon coloured purple.

Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over His Majesty's Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this nineteenth day of November, in the year of our Lord one thousand nine hundred and one.

Vesting a Reserve in the Patea County Council.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this eighteenth day of November, 1901.

Present:

THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been permanently set apart for ferry purposes:

And whereas, in the opinion of the Governor, it is expedient to vest the said land in the Patea County Council:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that, from and after the day of the date hereof, the reserve mentioned in the Schedule hereto shall become vested in “The Chairman, Councillors, and Inhabitants of the Patea County,” in trust, for ferry purposes.

SCHEDULE.

ALL that parcel of land in the Land District of Wellington, containing by admeasurement 4 acres 1 rood, more or less, being Section No. 6, Block I., Nukumaru Survey District. Bounded on the north by the Waitotara River; on the south-east by Section No. 4; and on the south-west by a public road: as the same is delineated on the plan deposited in the office of the Chief Surveyor, Wellington.
