Court certificate of title bearing date the twenty-second day of September, one thousand eight hundred and eighty-six, and now contained in partition order of the Native Land Court bearing date the thirteenth day of August, one thousand eight hundred and ninety-six, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has recommended that such restrictions be removed:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred upon him by the fifty-second section of “The Native Land Court Act, 1894,” and in accordance with the recommendation of the Native Land Court, doth hereby order and declare that all restrictions imposed by the said Native Land Court certificate and partition order on the alienation of the said land are hereby removed.

SCHEDULE.

ALL that parcel of land, containing 1,531 acres, more or less, known as Awarua No. 2a No. 2b, held under partition order of the Native Land Court, dated the 13th day of August, 1896, in favour of Noa te Hinanga and others, and containing the following restrictions: “Absolutely inalienable.”

As witness the hand of His Excellency the Governor, this sixth day of November, one thousand nine hundred.

Notice of Application to proclaim Kaitoke Creek and Moana-anu-anu Stream, together with all their Tributaries, Watercourses for the Deposit of Tailings, &c.

RANFURLY, Governor.

IN pursuance of the powers vested in him by section one hundred and nine of “The Mining Act, 1898,” His Excellency the Governor hereby notifies that application has been made to him to constitute and set apart by Proclamation the watercourses the name, locality, and description whereof are set forth in the Schedule hereto, to be watercourses into which may be discharged any tailings, débris, and waste water produced by or resulting from mining operations carried on under the said Act.

Any person who objects to such Proclamation being made, or whose land, or riparian or other rights in respect of such land, will be damaged or injuriously affected by the operation thereof, is required to serve on the Minister of Mines, within the period of ninety days after the publication hereof in the Gazette, full particulars of such objection, and also a claim in the prescribed form setting forth full particulars of all compensation that will be claimed by him in the event of such Proclamation being made.

No person will be entitled to any compensation for damage or injury consequent on the operation of such Proclamation unless his claim is duly served in the manner and within the period aforesaid.

SCHEDULE.

AUCKLAND LAND DISTRICT.

THAT stream known as the Moana-anu-anu Stream, Thames County, which flows north-easterly from its source near Ngapuketura Mountain for a distance of about six miles to the Whangamata Harbour, together with the tributaries thereof.

That part of the stream known as Kaitoke Creek, Great Barrier Island, which flows easterly from the western boundary-line of Section No. 141, Block VI., Fitzroy Survey District, for a distance of about three miles to the sea, together with the tributaries thereof.

Dated at Christchurch, this 8th day of November, 1900.

IN pursuance of the powers and authorities conferred upon me by the one-hundred-and-thirteenth section of “The Land Act, 1892,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby appoint Friday, the eleventh day of January, one thousand nine hundred and one, as the time at which the lands enumerated in the Schedule hereto shall be sold by public auction; and I do hereby fix the prices at which the said lands shall be sold as those mentioned in the said Schedule hereto.

AUCKLAND LAND DISTRICT.

Whangarei County.—Purua Survey District, Block IX.

Section 18: 4 acres 1 rood 23 perches; total upset price, £21 17s. 6d.

Section 19: 4 acres 1 rood 34 perches; total upset price, £22 6s. 3d.

Section 20: 7 acres and 5 perches; total upset price, £35 3s. 2d.

Section 21: 5 acres and 22 perches; total upset price, £25 12s. 6d.

Level lands of first-class quality, near Poroti Post-office, and twelve miles from Whangarei.

Rodney County.—Parish of Wharehine.

Section S. pt. 6: 27 acres; upset price, £6 15s. Open, poor land; three miles from Port Albert.

Rural Land in the Auckland Land District open for Sale or Selection.

IN pursuance and exercise of the powers and authorities conferred upon me by the one-hundred-and-thirty-sixth section of “The Land Act, 1892,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, having received the report of the Surveyor-General in this behalf, as in the said section is provided, do hereby declare that the rural land described in the Schedule hereto shall be open for sale or selection on and after the ninth day of January, one thousand nine hundred and one; and also that the land mentioned in the said Schedule may, at the option of the applicant, be purchased for cash, or be selected for occupation with right of purchase or on lease in perpetuity, or, in respect of any land containing or supposed to contain any metal, mineral, or valuable stone, be selected on lease in perpetuity only; and I do hereby also fix the prices at which the said land shall be sold, occupied, or leased, as mentioned in the said Schedule hereto, and do declare that the said land shall be sold, occupied, or leased under and subject to the provisions of “The Land Act, 1892.”

AUCKLAND LAND DISTRICT.—WHANGAROA COUNTY.

Unsurveyed Second-class Land.

ALL that area in the Auckland Land District, situate in Block VIII., Whangaroa Survey District, containing by admeasurement 150 acres, more or less. Bounded towards the north by Section No. 1 of Block VIII., Whangaroa Survey District; towards the north-east by Section No. 4 of the Parish of Mahinepua; towards the south-east by Section No. 1 of Block III., Kaeo Survey District; towards the south by the Hoahoaina Block; towards the west by the western boundary of Block VIII., Whangaroa Survey District; and towards the north and again towards the west by Section No. 2 of Block VIII. aforesaid to the point of commencement.

Description: Broken, mostly open with a little forest; situated about three miles from Whangaroa.

Cash price, 7s. 6d. per acre; occupation with right of purchase, 4·5d. per acre per annum; lease in perpetuity, 3·6d. per acre per annum.
