Native Land Court Notices

Aug. 2.] THE NEW ZEALAND GAZETTE. 1477

Native Land Court Notices.

"The Native Land Court Act, 1894."

IN THE NATIVE LAND COURT OF NEW ZEALAND.

In the matter of the succession to the interest of Karauria Pahura, deceased, in the Kopuatarakihī No. 1, Kopuatarakihī No. 2, Mangatuna No. 1, Mangatuna No. 2, and Waioro No. 3 Blocks, and of an application by Ani Kirimana, under section 39 of "The Native Land Court Act, 1894."

WHEREAS the said application was referred by me to the Native Land Court for inquiry and report, and the same has been duly reported on: And whereas the Court by its several orders dated respectively the 9th day of February, 1889, appointed Arapera Pahura to succeed to the interest of the said Karauria Pahura in the said lands: And whereas the said orders purport to have been made for the purpose of giving effect to the will of the said Karauria Pahura, whereby he devised the said lands to the said Arapera Pahura: And whereas the said lands were at the time of the making of the said will, and at the time of the death of the testator, held according to Native custom by certificate of title under "The Native Land Court Act, 1880": And whereas it appears that the said Arapera Pahura is not the person who would according to Native custom have been entitled to succeed to the interest of the said Karauria Pahura: And whereas the Court in giving effect to the said devise wrongly decided a point of law, the said lands not being legally devisable:

Now, therefore, for the purpose of remedying such error, and in exercise of the power vested in me by section 39 aforesaid, I by this order under my hand annul the said several orders dated the 9th day of February, 1889, to the intent that the Native Land Court may inquire and determine who are the persons who according to Native custom ought to succeed to the interest of the said Karauria Pahura in the said lands: Provided that any person aggrieved by this decision is at liberty to appeal within two months from the date of the publication hereof in the Gazette and Kahiti.

As witness my hand, this 28th day of June, 1900.

GEO. B. DAVY, Chief Judge.
