Powers delegated to the Waiau Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twelfth day of February, 1900.
Present:
THE RIGHT HONOURABLE R. J. SEDDON PRESIDING IN COUNCIL.
WHEREAS by the twelfth section of “The Public Domains Act, 1881,” it is, inter alia, enacted that the Governor, by Order in Council, may from time to time delegate all or any of the powers by the said Act conferred, save as is therein mentioned, to any person or persons, for any period, and subject to such stipulations as may be specified in such Order, and that every such delegation may from time to time in like manner be altered or revoked: And whereas, pursuant to “The Public Reserves Act, 1881,” by an Order in Council of even date herewith, the lands described in the Schedule hereto, situate in the Canterbury Land District, are declared to be brought under the operation of and to be subject to the provisions of the said “Public Domains Act, 1881”:
Now, therefore, His Excellency the Governor, by and with the advice and consent of the Executive Council of the Colony of New Zealand, doth hereby, and in respect of the land hereinafter mentioned, delegate all the powers conferred by the said Act, except the powers conferred by sections five and twelve thereof, for the period of ten years from the date hereof (unless previously altered or revoked under the said Act), to the under-mentioned persons, who shall be known as the Waiau Domain Board, namely,—
JOHN O’MALLEY, Waiau, Clerk;
JOHN COAKLEY, Waiau, Storekeeper;
THOMAS O’CARROLL, Waiau, Storekeeper;
WILLIAM RICHARD CREED, Waiau, Mail Contractor;
GEORGE HOARE, Mendip Hills, Waiau, Shepherd;
THOMAS MELDRUM MARR, Balcairn, Waiau, Schoolmaster;
PHILIP HENRY DALE, Waiau, Hotelkeeper
(herein referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

The Board shall meet for the transaction of business on the first Tuesday in each month, at eight o’clock p.m., at the Public Library, Waiau, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Tuesday, the sixth day of March, one thousand nine hundred.

Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting, and no other business than that so specified shall be transacted at such meeting.

Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Tuesday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

The Board shall prepare and submit at each annual meeting a report of the proceedings of the Board for the previous year ending on the thirty-first day of December, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

All questions shall be determined by the majority of votes of the members of the Board present at a meeting.
And with the like advice and consent as aforesaid doth hereby also order that this delegation shall take effect in respect of the parcel of Crown lands described in the Schedule hereto.
SCHEDULE.
ALL that parcel of land in the Canterbury Land District, containing by admeasurement 40 acres, more or less, being Section No. 1, Block XIII., Waiau Survey District. Bounded towards the north-east by Section 2, Block XIII.,
Waiau Survey District, 288 links, and by Section 303, Square 84, 1406 links; towards the south-east partly by Section 273, Square 84, and partly by Section 304, Square 84, 2586 links; towards the south-west by Balmoral Street, 840 links, and by Lyndon Street, 1150 links; and towards the north-west by Fernihurst Street, 600 links, by Parnassus Street, 1204 links, by Section 3, Block XIII., 671 links, and by Clarence Street, 100 links: be all the aforesaid linkages more or less: as the same is delineated on the plan deposited in the office of the Chief Surveyor, Christchurch.

BY virtue of the powers and authorities vested in me by the twenty-fourth section of “The Public Reserves Act, 1881,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, do hereby order and declare that the reserve made for public recreation in the Canterbury Land District, and described in the Schedule hereto, shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of “The Public Domains Act, 1881”; and such domain shall hereafter be managed, administered, and dealt with in manner directed by the said Act.
SCHEDULE.
ALL that parcel of land in the Canterbury Land District, containing by admeasurement 3 roods 4 perches, more or less, being Reserve No. 3412, Town of Arowhenua. Bounded towards the north by Town Sections 691 and 692, 498·8 links; towards the east by Maude Street, 181·6 links; towards the south by the reservation along the Taumata-kaha Stream; and towards the west by Ormsby Street, 199·3 links: be all the aforesaid linkages more or less; as the same is delineated on the plan deposited in the office of the Chief Surveyor, Christchurch.

SCHEDULE.
ALL that parcel of land in the Taranaki Land District, containing 12 acres 1 rood 5 3/10 perches, being Subdivision No. 1, part of Section No. 12, Block X., Ngaire Survey District: also part of Allotment No. 6, part of Section No. 75, of Block X., Ngaire Survey District; and also all those parcels of land delineated and marked as “street” in Plan No. 1360, deposited in the Land Transfer Office, Taranaki, being parts of the said Sections Nos. 12 and 75, and being all the land contained in certificate of title, Vol. xxxviii., folio 169, Taranaki.
