Act, 1876," and its amendments, and in pursuance of all other powers thereto it enabling, make the by-laws following for the purpose of imposing upon every person in occupation of any premises within the said road district the duty of cleansing all earth-closets, privies, ashpits, and cesspools in, upon, and about such premises, and for the purpose of preventing any nuisance arising from the accumulation of filth, dust, ashes, and rubbish.

No privy or earth-closet shall be permitted to exist on any allotment at a less distance than 15 ft. from any house or building used as a dwelling, or any road or footpath, and 5 ft. from any boundary-fence of any occupied allotment.

Every privy or closet shall have a water-tight box of a size not more than 3 cubic feet, or such other receptacle as the said Local Board of Health may from time to time prescribe, and the occupier of the premises shall cause earth or other deodorising substances to be used daily.

No person shall be allowed to bury or otherwise dispose of any nightsoil, or dead animal, or any offensive matter, on any allotment of less area than 2 acres, unless permitted by an order of the Board; and no person shall deposit any nightsoil, dead animal, or any offensive matter, or any rubbish, on any road, by-way, or public or private vacant allotments.

The said local Board of Health shall make such provision as it shall think fit, by contract or otherwise, with any person or persons, authorising such person or persons thereinafter called “the contractor”) to periodically remove from every building, dwellinghouse, or other tenement or premises within the said road district, at the expense of the owners and occupier thereof, the contents of any earth-closet, privy, ashpit, and cesspool, and any nightsoil, dung, ashes, slops, filth, refuse, or rubbish of any kind.

The owner or occupier of any such building, dwellinghouse, or other tenement or premises shall pay to the “contractor” for the removal of any of the said matters mentioned in the preceding clause of this by-law such amount as shall be fixed and determined by the said Local Board of Health in the contract or agreement with the “contractor.”

The said Local Board of Health may employ such person as it thinks fit as its officer or inspector for the purpose of inspecting the condition of any earth-closet, privy, ashpit, and cesspool in, upon, or about any building, dwellinghouse, tenement, or premises within the said district; and such officer or inspector shall have the right at all reasonable hours to enter into or upon any building or land within the said road district for the purpose of examining and reporting upon the condition of any earth-closet, privy, ashpit, and cesspool thereon, or for the purpose of ascertaining whether any ashes, slops, filth, refuse, or rubbish of any kind has been allowed to accumulate in, upon, or about any such building or land.

The said “contractor” shall, for the purpose of carrying out and performing his contract with the said Local Board of Health, have the right to enter in and upon any land and premises within the said road district, within such hours as shall be prescribed by the said Local Board of Health, for the purpose of removing the contents of any earth-closet, privy, ashpit, or cesspool, and any nightsoil, dung, ashes, filth, rubbish, or refuse of any kind.

The officer or inspector referred to in clause 6 hereof may, if he finds that any earth-closet, privy, ashpit, or cesspool upon or about any land or premises within the said district has not been properly cleansed and the contents thereof removed, or that any owner or occupier has allowed any nightsoil, dung, ashes, slops, filth, rubbish, or refuse of any kind to accumulate in, upon, or about such premises, order the said contractors to remove the same at the expense of the owner or occupier of any such land or premises.

No manure or refuse from horses, cows, pigs, or other animals, or from fowls, ducks, or geese shall be allowed to accumulate on any premises so as to become a nuisance.

Any person who shall obstruct any officer or other person employed under the provisions of this by-law by the said Local Board of Health, or any contractor authorised by the said Local Board to remove any of the matters referred to in this by-law or in any clause hereof, in the performance of anything which such officer or other person or “contractor” is or may be required or authorised to do by or under this by-law, or under any contract or agreement made hereunder, or who shall commit any other breach of this by-law, shall be liable for every such offence to a penalty not exceeding £5.

This by-law shall come into operation upon the date of publication in the New Zealand Gazette.
Passed by the said Local Board of Health by special order, and the common seal of the Board affixed thereto, on the 9th day of October, 1899.

COOK COUNTY COUNCIL.—PATUTAHI LOAN DISTRICT.
I HEREBY give notice that at a poll of the ratepayers in this special district, taken on Monday, the 11th September, 1899, upon a proposal by this Council to raise a loan of £2,000 for the construction of the Quarry Road, Patutahi, the following votes were recorded:—
For the proposal, 12 ratepayers exercised 28 votes; against the proposal, 1 ratepayer exercised 3 votes: total number on the roll, 22 ratepayers, capable of exercising 51 votes.
As a majority of the ratepayers voted in favour of the proposal, and the number so voting exercised a majority of the votes in favour of the proposal, I declare it carried.

Notice of the Laying-off of Road through Waikopiro B Block, Takapau Survey District.
NOTICE is hereby given, by direction of His Excellency the Governor of the Colony of New Zealand, under the authority of section 92 of “The Public Works Act, 1894,” that the road described in the Schedule hereto was, in October, 1898, duly taken and laid off through the land specified in the said Schedule, under the authority of the Governor of the said colony, by a warrant dated the 28th November, 1896.
