ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-sixth day of January, 1899.

Present:

THE HONOURABLE A. J. CADMAN PRESIDING IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required to be taken for a public work, to wit, for the purposes of a road in Kokohuia Block, Hokianga Survey District:

And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown: And whereas a map in duplicate has been prepared of the said land by the Hokianga County Council, as required by the eighty-eighth section of “The Public Works Act, 1894”:

Now, therefore, in pursuance and exercise of the powers vested in him by the eighty-eighth section of the said Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the land shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purposes of the said road, and the said land shall vest in the Hokianga County Council, as from the sixteenth day of March, one thousand eight hundred and ninety-nine.

Notice of Intention to change the Purpose of a Reserve in the Auckland Land District.

RANFURLY, Governor.

WHEREAS by “The Public Reserves Act, 1881,” it is, amongst other things, enacted that the Governor may declare his intention to make, change, exchange, or alter the dedication of any public reserve now or hereafter vested in Her Majesty or the Governor for any of the purposes named in Class II. of the Schedule to the said Act, whether the same be granted or not; if it shall, in the opinion of the Governor, be expedient to change the purpose of such reserve or any part thereof from the purpose or presumed purpose for which it was set apart to any other purpose, or if it shall, in the opinion of the Governor, be expedient to exchange any of the land comprised in such reserve for other land of equal value, to be dedicated to one or more purposes named in the said Class II., the Governor may, by notice gazetted, declare his intention to make such change, exchange, or dedication, as the case may be, and in such notice declare the manner and terms in which the same is intended to be so made :

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby, in exercise and pursuance of the powers and authorities vested in me by “The Public Reserves Act, 1881,” aforesaid, declare my intention to change the specific purpose of the reserve described in the Schedule hereto from a public-hall site to a site for a Mechanics’ Institute and Athenæum.


SCHEDULE.

ALL that parcel of land in the Auckland Land District, being part of Section No. 3 of the Parish of Mangapai, and containing by admeasurement 3 roods, more or less. Bounded towards the north by a public road, 392 links; towards the east by a public road, 192 links; and towards the south and west by other portion of Section No. 3 of the Parish of Mangapai, 438 and 182 links respectively, to the point of commencement: be all the aforesaid linkages more or less.

As witness the hand of His Excellency the Governor, this twentieth day of January, one thousand eight hundred and ninety-nine.

Bounded towards the north-east and south-east by Section No. 156a of the Parish of Omaha, 250 and 200 links respectively; towards the south-west by Section No. 156b of the Parish of Omaha, 250 links; and towards the north-west by a public road, 200 links, to the point of commencement: be all the aforesaid linkages more or less.

As witness the hand of His Excellency the Governor, this twentieth day of January, one thousand eight hundred and ninety-nine.
