Additional Regulations under “The Mining Act, 1898.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of June, 1899.

Present:

His Excellency the Governor in Council.

IN exercise of the powers conferred upon him by “The Mining Act, 1898,” and of all other powers and authorities enabling him in this behalf, His Excellency the Governor, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the additional regulations hereunder set forth, and doth hereby declare that they shall be read together with the regulations (hereinafter called “the principal regulations”) made by Order in Council dated the twenty-seventh day of January, one thousand eight hundred and ninety-nine, and gazetted on the thirtieth idem.

ADDITIONAL REGULATIONS.

MARKING-OUT OF CLAIMS AND OTHER MINING PRIVILEGES.

  1. Clause 22 of the principal regulations is hereby amended as follows:—

(1.) It shall be sufficient if the pegs stand not less than 2 ft. above the surface of the ground, in lieu of 3 ft.

(2.) Without affecting the requirement of pegs at the angle-points, it shall be sufficient if along the boundary-line the distance between any one peg and the next does not exceed 1,200 ft. in the case of a race, tunnel, or road, and 600 ft. in any other case.

(3.) In lieu of cutting a trench it shall be sufficient if the direction of the boundary-line on each side of the peg is shown by a finger-post or tree-blazing, or in any other manner reasonably sufficient for the purpose.

(4.) So much of subclause (5) of clause 22 as refers to the therein-mentioned initial letters is hereby revoked.

APPLICATIONS IN RESPECT OF MINING PRIVILEGES.

  1. It shall not be necessary for the applicant, his solicitor or agent, to attend in person at the office of the Registrar for the purpose of filing the application; and, in the event of the application reaching the office after office-hours, the time of filing shall be deemed to be the time when the office is next open for business.

  2. The sketch-plan referred to in subclause (4) of clause 23 of the principal regulations shall not be necessary, and that subclause is hereby revoked accordingly:

Provided that any time before the application is finally disposed of the Warden may require the applicant to supply a plan.

3A. The notification to be given by the applicant under subclause (9), and the duplicate original to be posted by him on the ground under subclause (10) of the aforesaid clause 23 shall be respectively given and posted on the day of the filing of the application, or as soon thereafter as is practicable, anything in those subclauses to the contrary notwithstanding.

REGISTRATION OF MINING PRIVILEGES, AND OF INSTRUMENTS AFFECTING THE SAME.

Register.

  1. The Register may be divided into parts as follows:— Part I.: Claims. Part II.: Water-rights. Part III.: Business-site Licenses. Part IV.: Residence-site Licenses. Part V.: Special-site Licenses. Part VI.: Mineral Licenses. Part VII.: Miscellaneous. And registrations may be recorded accordingly, nevertheless without affecting the numerical sequence of the instruments registered.

Annual Renewal of Registration in the Case of Licenses for Water-races.

  1. Within thirty days after the expiration of one year after the date of the original registration of any license for a water-race, and within the same period after the expiration of each subsequent year of the term of the license, the registration thereof shall be renewed by the licensee, and for that purpose the following provisions shall apply:—

(1.) Such renewal shall be effected in the same manner, mutatis mutandis, as in the case of the original registration, save that the license shall be produced to the Registrar, and that the entry to be made in the Register, as also the memorial to be indorsed on the license, shall specify the date
