Altering the Name of the Town of Birmingham.

A PROCLAMATION.
WHEREAS by sections two and three of “The Designation of Districts Act, 1894” (hereinafter termed “the said Act”), it is provided that the Governor in Council may, at the request or with the consent of the Council of any county, city, or borough, alter the geographical name or designation of any place or locality in the colony:
And whereas the Kiwitea County Council has requested that the present name of “Birmingham,” within the County of Kiwitea, be altered as hereinafter mentioned, and it appears expedient to comply with such request:
Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, acting by and with the consent of the Executive Council of the said colony, do hereby proclaim and declare that the Township of Birmingham, in the County of Kiwitea aforesaid, shall, on and after the fourth day of February, one thousand eight hundred and ninety-nine, be called and known by the name of “Kimbolton,” and the name of the said Township of Birmingham is hereby altered accordingly.
Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Commander of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this first day of August, in the year of our Lord one thousand eight hundred and ninety-eight.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this nineteenth day of November, 1898.

THE HONOURABLE A. J. CADMAN PRESIDING IN COUNCIL.
WHEREAS the lands mentioned in the Schedule hereto are required to be taken for a public work, to wit, the construction of a road through Block IX., Maramarua Survey District:
And whereas the said lands are held or occupied by Native owners under a title which is not derived from the Crown:
And whereas a map in duplicate has been prepared of the said lands, as required by the eighty-eighth section of “The Public Works Act, 1894”:
Now, therefore, in pursuance and exercise of the powers vested in him by the eighty-eighth section of the said Act, and of all other powers in anywise enabling him in that behalf, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby declare that the lands shown upon such map, and described in the Schedule hereto, shall be deemed to be taken for the purpose of the said road, and the said lands shall vest in Her Majesty the Queen as from the fifteenth day of January, one thousand eight hundred and ninety-nine.

Revoking Warrant making Rules and Regulations for the Management of the Papakaio Portion of the Waitaki Islands.

IN pursuance of the power and authority conferred upon me by section four of “The Land Act, 1892,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby revoke the warrant dated the twenty-sixth day of January, one thousand eight hundred and ninety-eight, and published in New Zealand Gazette No. 7, of the third day of February, one thousand eight hundred and ninety-eight, making rules and regulations for the management of the Papakaio portion of the Waitaki Islands.
As witness the hand of His Excellency the Governor, this fifth day of January, one thousand eight hundred and ninety-nine.

Rules and Regulations for the Management of the Papakaio Portion of the Waitaki Islands.

WHEREAS by section four of “The Land Act, 1892” (hereinafter termed “the said Act”), the Governor is empowered to make, alter, or revoke rules, regulations, and orders for, among other things, the care, management, and protection in every manner of all unoccupied Crown lands: Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred by the said Act, do hereby make the following rules, regulations, and orders for the care and management of the Crown lands within the banks of the Waitaki River described in the First Schedule to such regulations, which shall hereafter be known as the Papakaio portion of the Waitaki Islands, and do hereby declare that such regulations shall come into force on the day of the gazetting hereof.
REGULATIONS.

For the purpose of carrying out these regulations five persons shall be elected at a public meeting of the holders of licenses to depasture cattle or stock upon the said islands (hereinafter termed “licensed holders”), at Awamoko, on Friday, the 27th day of January, 1899; and the names of such persons, when so elected, shall be submitted to the Governor for approval, and, if so approved, shall be a Committee for the care, management, and protection of the said islands, and shall be known as the Papakaio (Waitaki Islands) Committee (hereinafter referred to as “the Committee”). Three of such Committee shall retire by ballot in December in each year, but they shall be eligible for reappointment as hereinafter provided.

On the first Wednesday in January in each year an election shall take place from among the “licensed holders,” for the purpose of electing three members of the Committee instead of the three retiring members; and the names of such persons, when so elected, shall be submitted to the Governor for approval, and if so approved they shall take the place of the three retiring members.

The Committee shall meet for the transaction of business on the first Wednesday in each month, at 2 o’clock p.m., at Awamoko, or at such other time or place as may from time to time be fixed by the Committee. The first meeting shall be held on Wednesday, the 1st day of February, 1899.

Special meetings may be convened by the Chairman or by any two members of the Committee, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting, and no other business than that so specified shall be transacted at such meeting.

Any three of the said Committee shall form a quorum. Any meeting may be adjourned from time to time.

The members of the Committee shall, at their first meeting, and thereafter at an annual meeting to be held on the first Wednesday in January in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor. At such meeting a Secretary shall also be appointed by the Committee.
