Removal of Restrictions on Alienation of Native Land.

RANFURLY, Governor.

WHEREAS application has been made to the Governor by the owners of the land described in the Schedule hereto, praying that the restrictions on the alienation of such land contained in the Land Transfer certificate of title bearing date the first day of December, one thousand eight hundred and eighty-seven, and now contained in the Land Transfer certificate bearing date the fifteenth day of November, one thousand eight hundred and ninety-five, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has recommended that such restrictions be removed:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred upon him by the fifty-second section of “The Native Land Court Act, 1894,” and in accordance with the recommendation of the Native Land Court, doth hereby order and declare that all restrictions imposed by the said Land Transfer certificates on the alienation of the said land are hereby removed.

SCHEDULE.

ALL that parcel of land, containing 3 roods 37·4 perches, more or less, situate in the City of Wellington, being Section 2A of Subdivision XV.B of the Polhill’s Gully Native Reserve, held under Land Transfer certificate dated the 15th November, 1895, and containing the following restrictions: “Inalienable by sale or mortgage, or by lease beyond twenty-one years.”

As witness the hand of Sir James Prendergast, Knight, Chief Justice, for and on behalf of His Excellency the Governor, and as his duly appointed Deputy, this twenty-first day of April, one thousand eight hundred and ninety-nine.

The Education Act, 1877.”—Payments to Education Boards.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-fifth day of April, 1899.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN exercise and pursuance of the powers and authorities vested in him by “The Education Act, 1877,” His Excellency the Governor, with the advice and consent of the Executive Council of the colony, doth hereby make the regulation hereto annexed regarding certain payments of capitation allowance to Education Boards; and, with the like advice and consent, doth hereby prescribe that this Order shall come into force on the date of the first publication thereof in the New Zealand Gazette.

REGULATION.

Notwithstanding anything to the contrary contained in an Order in Council made on the 5th day of January, 1888, under the provisions of “The Education Act, 1877,” relating (inter alia) to attendance registers and returns, the payment of capitation allowance to Education Boards for the quarter ending on the 30th day of June, 1899, shall be according to the working-average attendance of the quarter ending on the 31st day of March, 1899, as working average was defined by Order in Council dated the 5th day of July, 1887, and made under the provisions of the before-mentioned Act.

Duty leviable on certain Matches.

IN exercise of the powers in me for that purpose vested by “The Customs and Excise Duties Act, 1888,” I, Uchter John Mark, Earl of Ranfurly, Governor of the Colony of New Zealand, do hereby direct that, from and after the date hereof, there shall be levied upon matches of any material other than wood or wax, and which possess properties in the whole or in part which can be used for similar purposes as matches of wood or wax, a duty corresponding to the duty payable on wooden matches.

As witness the hand of Sir James Prendergast, Knight, Chief Justice, for and on behalf of His Excellency the Governor, and as his duly appointed Deputy, this eleventh day of April, one thousand eight hundred and ninety-nine.

Vaccination Districts constituted.

RANFURLY, Governor.

IN pursuance and exercise of the powers vested in the Governor by “The Public Health Act, 1876,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby abolish the existing vaccination districts known as the Stratford, Waimate Plains, Hawera, and Waitara Districts, and do declare that the territory heretofore comprised within the said districts is hereby divided anew into five vaccination districts, the names whereof shall be the Eltham, Stratford, Waimate Plains, Hawera, and Waitara Districts, and the boundaries whereof shall be coterminous with the boundaries of the marriage districts bearing the same names, as are set forth in a Proclamation of even date herewith, made under the provisions of “The Marriage Act, 1880.”

As witness the hand of Sir James Prendergast, Knight, Chief Justice, for and on behalf of His Excellency the Governor, and as his duly appointed Deputy, this twenty-first day of April, one thousand eight hundred and ninety-nine.

Altering the Name of the Borough of Newton.

A PROCLAMATION.

WHEREAS by sections two and three of “The Designation of Districts Act, 1894” (hereinafter termed “the said Act”), it is provided that the Governor in Council may, at the request or with the consent of the Council of any county, city, or borough, alter the geographical name or designation of any place or locality in the colony:

And whereas the Newton Borough Council has requested that the present name of “Newton” be altered as hereinafter mentioned, and it appears expedient to comply with such request:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, acting by and with the consent of the Executive Council of the said colony, do hereby proclaim and declare that the Borough of Newton aforesaid shall, on and after the sixteenth day of August, one thousand eight hundred and ninety-nine, be called and known by the name of “Grey Lynn,” and the name of the said Borough of Newton is hereby altered accordingly.

Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this sixth day of February, in the year of our Lord one thousand eight hundred and ninety-nine.
