Extending the Time for holding Annual Meeting of the Waihemo County Council.

IN pursuance of the powers vested in him by section three hundred and twenty-two of “The Counties Act, 1886,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby extend the time appointed for holding the annual meeting of the Council of the County of Waihemo from Wednesday, the twenty-third day of November, one thousand eight hundred and ninety-eight, to Saturday, the seventeenth day of December, one thousand eight hundred and ninety-eight.

Regulations for Perch, Carp, &c., Fishing, Lake Mahinapua, Westland.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this nineteenth day of November, 1898.

THE HONOURABLE A. J. CADMAN PRESIDING IN COUNCIL.

IN pursuance of the powers and authorities vested in him by “The Fisheries Conservation Act, 1884,” His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations for the purposes of the said Act, and doth hereby declare that such regulations shall have effect within the County of Westland, and shall apply to the waters of Lake Mahinapua and its affluents and effluents, Mahinapua Creek and the tributaries thereof.

  1. Licenses to fish for perch, carp, and tench only in Lake Mahinapua and its affluents and effluents, Mahinapua Creek and the tributaries thereof, will be issued by the Secretary of the Westland Acclimatisation Society; and for any such license a fee of five shillings shall be paid: Provided that it shall not be obligatory upon the said Secretary to issue a license.

  2. Licenses, when issued as aforesaid for the whole season, shall entitle the person named therein to fish in any of the said waters from the first day of December in any one year to the fifteenth day of April in the year following; but no such license shall confer any right of entry upon the land of any person without his consent.

  3. No person shall take or attempt to take perch, carp, or tench without a license; and every person taking or attempting to take perch, carp, or tench shall, on demand of any Ranger, constable, or person producing a license, produce and show to such Ranger, constable, or person his license, and the contents of his creel or bag.

  4. Every carp, tench, or perch not exceeding six inches in length, from nose to tip of tail, taken or caught by any person, shall immediately be returned alive into the water from which the same is taken.

  5. No person shall put, throw, or place, or allow to be put, thrown, or placed, in any of the said waters any sawdust or sawmill refuse, or anything of any kind or description whatever poisonous, deleterious, or noxious to fish. This shall not apply to débris or tailings from mining claims.

  6. No person shall sell, or expose or offer for sale, or have in his possession for purpose of sale, within the County of Westland, the Boroughs of Hokitika, Kumara, or Ross, any of the perch, carp, or tench, or take, fish for, catch, or kill any of the perch, carp, or tench, in order to make sale of same.

  7. Any fish-dealer having on his business premises any of the perch, carp, or tench shall be deemed to have them in his possession for purposes of sale.

  8. No person shall put, throw, drag, or place, or allow to be put, thrown, dragged, or placed, for any purpose whatever, any net of any description (except a landing-net) in any of the said streams or lake.

  9. No person shall take, catch, or kill any perch, carp, or tench, or have any of the said fish in his possession, between the fifteenth day of April and the first day of December in any year.

  10. For the purposes of these regulations “the mouth of every such river or stream” shall be deemed to include every outlet of the same, and the sea-shore between such outlets, and shall extend over a radius of one-third of a mile from the point or line where the waters of such river or stream meet those of the sea or of any harbour at low water.

  11. The penalty for the breach of any of these regulations shall be not more than five pounds nor less than five shillings.

Licensing E. Morrison to use and occupy a Part of the Foreshore of the Mahurangi River as a Wharf-site.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this nineteenth day of November, 1898.

Present:

THE HONOURABLE A. J. CADMAN PRESIDING IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned under “The Harbours Act Amendment Act, 1883” (hereinafter called “the said Act”), Edward Morrison, of Red Bluff, in the County of Rodney, settler (hereinafter called “the licensee”), has applied to the Governor in Council for a license under the said Act to occupy a part of the foreshore, and of the land below low-water mark adjacent thereto, on the Mahurangi River, in order to erect a wharf thereon, and, in accordance with the one-hundred-and-fifty-sixth section of “The Harbours Act, 1878,” has deposited plans in the office of the Marine Department at Wellington (marked M.D. 2234), showing the area of foreshore and land below low-water mark intended to be occupied, and the manner in which it is proposed to erect the wharf: And whereas the Governor in Council has approved of the purpose for which the said foreshore and land below low-water mark are to be occupied: And whereas it is expedient that a license should be granted and issued to the licensee under the said Act, for the purpose aforesaid, on the terms and conditions hereinafter expressed:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said colony, doth hereby approve of the object for which the said license is required by the licensee as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the licensee to use and occupy that part of the foreshore and of the land below low-water mark on which the wharf is to be erected, as shown on the plans so deposited as aforesaid, for the purpose of erecting and maintaining the said wharf thereon, such license to be held and enjoyed by the licensee upon and subject to the following terms and conditions, that is to say:—
