Vesting Control of the Glentunnel Bridge in the Selwyn County Council, and apportioning Cost of Maintenance.

A PROCLAMATION.

WHEREAS by section one hundred and fourteen of “The Public Works Act, 1894” (hereinafter termed “the said Act”), it is, inter alia, enacted that the Governor may, by Proclamation publicly notified, direct that any bridge already constructed, or which may hereafter be constructed, over or across any river or arm of the sea shall, from and after a date to be fixed by such Proclamation, be under the exclusive care, control, and management of such local authority as shall be mentioned in that behalf in such Proclamation; and may by any such Proclamation as aforesaid fix and determine whether all or any, and, if so, what part, of the cost, whether theretofore incurred or thereafter to be incurred, of maintaining, repairing, improving, or reconstructing any such bridge, is to be provided and paid by any local authority or authorities, and, if so, by what local authority or authorities; and may by any such Proclamation as aforesaid direct how, and when, and to whom any such payment is to be paid:

And whereas by the said Act it is further provided that the Governor may from time to time, with the view of determining whether it is expedient to vest the exclusive care, control, management, and maintenance of any such work in any local authority, direct any person to be a Commissioner to inquire into and report to him upon any matter which he shall deem necessary to enable him to determine any such question as aforesaid:

And whereas a Commissioner was appointed and an inquiry was duly held with a view to determining what local authority could most conveniently and efficiently control the work mentioned in the Schedule hereto, and herein-after referred to as “the said bridge,” and what proportion of the cost of maintaining, repairing, improving, or reconstructing the said bridge should be paid by any, and, if so, which, local authority or authorities: And whereas such Commissioner did report to the Governor after due inquiry his opinion as to the matters respecting which he was appointed to report:

And whereas it is expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in pursuance and in exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby proclaim and direct that the said work described in the Schedule hereto, and known as “the Glentunnel Bridge,” shall, from and after the date of this Proclamation, be under the exclusive care, and control, and management of the Selwyn County Council; and in further pursuance of the aforesaid powers and authorities I do hereby fix and determine that the cost of maintaining, repairing, improving, or reconstructing the said bridge shall be borne by the Rakaia Road Board in the proportion of two-sixths, Lake Coleridge Road Board three-sixths, and South Malvern Road Board one-sixth of the cost.

And I do hereby fix and determine that the cost of maintaining, repairing, improving, or reconstructing the said bridge from time to time shall be borne by the said local bodies in the said proportions respectively.

And I do hereby also further direct that any contribution hereby required to be made as aforesaid by the Rakaia, Lake Coleridge, and South Malvern Road Boards shall be paid from time to time respectively, in the proportions hereinbefore prescribed, out of the funds of the said Road Boards, in each case within a period of thirty days after demand in writing made by or on behalf of the Selwyn County Council, and all such payments shall be made from time to time to the Clerk of the said County Council for and on account of such County Council.

SCHEDULE.

The bridge over the River Selwyn, at the crossing of the Wairiri Valley Road, as the site of the same is delineated upon the plan marked S.G. 25249, deposited in the Head Office, Department of Lands and Survey, at Wellington, in the Wellington Land District, and thereon coloured red.

Given under the hand of His Excellency the Right Honourable Uchter John Mark, Earl of Ranfurly; Knight Commander of the Most Distinguished Order of Saint Michael and Saint George; Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twenty-third day of November, in the year of our Lord one thousand eight hundred and ninety-eight.

A PROCLAMATION.

WHEREAS by the second section of “The Government Loans to Local Bodies Act Amendment Act, 1891” (herein termed “the said Act”), it is, amongst other things, enacted that, before certain moneys therein mentioned shall be expended upon any block of land, it shall be necessary that the same be proclaimed as set apart for settlement:

Now, therefore, in pursuance and exercise of every power and authority enabling me in this behalf, and for the purposes of the said Act, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby proclaim the block of land described in the Schedule hereto as set apart for settlement.

SCHEDULE.

NGAPAERURU BLOCK.

All that parcel of land in the Hawke’s Bay Land District, containing 37,599 acres, more or less, situate in the Mangatoro, Tahoraiti, and Porangahau Survey Districts, being the Ngapaeruru Nos. 1A, 2A, 3A, 4A, 5, 6A, 6C, 7A, 8, and 9 Blocks. Bounded towards the north by the Ngapaeruru No. 1B Block, the Mangapuaka and the Ngapaeruru Nos. 2B, 4B, 6B, and 6D Blocks; towards the east by the Mangaorapa Block, the Mangawaangiangi Block, and the Ngapaeruru No. 7F Block; towards the south by Section No. 1, Block XI., and Section No. 1, Block X., Weber Survey District; towards the south-west and west by the Mangatoro No. 4 Block, the Ngapaeruru No. 7B Block, the Mangatoro No. 2 Block, the Ngapaeruru No. 10 Block, the Mangamaere Stream, the Mangatoro No. 1 Block, the Kopukokomiko Stream, the Manawatu River, and the Mangapuaka Stream: as the same is delineated upon the plan marked S.G. 38080, deposited in the Head Office of the Lands and Survey Department, at Wellington, in the Wellington Land District, and thereon edged with red.

A PROCLAMATION.

WHEREAS the land mentioned in the Schedule hereto is required to be taken, under “The Public Works Act, 1894,” for a certain work, to wit, the construction of a public road in Eparaima Native Reserve, Motuotaraiia Survey District:

And whereas the Patangata County Council has laid before the Governor the memorial, accompanied by a map, and also the statutory declaration, required by the said Act:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities vested in me by “The Public Works Act, 1894,” and of every other power and authority in anywise enabling me in that behalf, do hereby proclaim and declare that, from and after the date of the publication hereof in the New Zealand Gazette, the land mentioned in the Schedule hereto is hereby taken for the purposes of a public road.
