Regulations as to Whitebait-fishing.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirty-first day of October, 1898.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The Sea-fisheries Act, 1894” (hereinafter termed “the said Act”), it is amongst other things enacted that the Governor in Council may from time to time make regulations for the purposes therein mentioned, which shall have general force and effect throughout the colony, or particular force and effect only in any waters or places specified therein:

And whereas it is expedient to make the regulations hereinafter set forth in respect to the indigenous fish known as whitebait, inhabiting the waters of the colony herein mentioned:

Now, therefore, His Excellency the Governor of the Colony of New Zealand in pursuance and exercise of the powers conferred upon him by the said Act, and by and with the advice and consent of the Executive Council of the said colony, doth hereby make the following regulations, and doth declare that such regulations shall have force and effect in the Colony of New Zealand and the waters thereof:—

REGULATIONS.

  1. No person shall take whitebait by the use of nets in paddocks which are formed by constructing groins from the banks of rivers and streams, and making holes for the fish between the groins and the banks.

  2. Any person committing a breach of the above regulation shall be liable to a penalty of not less than £1 and not exceeding £20.

Fixing Date of Payment of Land-tax for the Year 1898-99.

RANFURLY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirty-first day of October, 1898.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the power and authority vested in him under “The Land-tax and Income-tax Act, 1898,” His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby order and determine that the respective duties leviable under the said Act by way of land-tax, and of further graduated land-tax, shall be paid in one sum on Monday, the twenty-eighth day of November, one thousand eight hundred and ninety-eight.

And in further pursuance and exercise of the power and authority aforesaid, and with the like consent and advice as aforesaid, His Excellency doth also determine that the place where the said duties of land-tax shall be paid shall be the office of the Commissioner of Taxes, at the Government Buildings, Wellington; and that notice to the foregoing effect shall be given by the said Commissioner accordingly.

Removal of Restrictions on Alienation of Native Land.

RANFURLY, Governor.

WHEREAS application has been made to the Governor by the Native owner of the land described in the Schedule hereto, praying that the restrictions on the alienation of such land contained in the Land Transfer certificate bearing date the twelfth day of November, one thousand eight hundred and ninety-two, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has recommended that such restrictions be removed:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred on him by the fifty-second section of “The Native Land Court Act, 1894,” and in accordance with the recommendation of the Native Land Court, doth hereby order and declare that the restrictions imposed by the said Land Transfer certificate on the alienation of the said land are hereby removed.


SCHEDULE.

ALL that parcel of land, situate in the Provincial District of Nelson, containing 185 acres 1 rood 7 perches, more or less, being Sections 74, 75, 76, 77, 78, and 85, Square 14, Aorere, held under Land Transfer certificate dated the 12th November, 1892, in favour of Huria Matenga, and containing the following restrictions: “Inalienable, except with the consent of the Governor, by sale or mortgage, or by lease for a longer period than twenty-one years.”

As witness the hand of His Excellency the Governor, this twenty-seventh day of October, one thousand eight hundred and ninety-eight.

Notice of Intention to change the Purpose of a Reserve in the Wellington Land District.

RANFURLY, Governor.

WHEREAS by “The Public Reserves Act, 1881,” it is, amongst other things, enacted that the Governor may declare his intention to make, change, exchange, or alter the dedication of any public reserve now or hereafter vested in Her Majesty or the Governor for any of the purposes named in Class II. of the Schedule to the said Act, whether the same be granted or not; if it shall, in the opinion of the Governor, be expedient to change the purpose of such reserve or any part thereof from the purpose or presumed purpose for which it was set apart to any other purpose, or if it shall, in the opinion of the Governor, be expedient to exchange any of the land comprised in such reserve for other land of equal value, to be dedicated to one or more purposes named in the said Class II., the Governor may, by notice gazetted, declare his intention to make such change, exchange, or dedication, as the case may be, and in such notice declare the manner and terms in which the same is intended to be so made:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby, in exercise and pursuance of the powers and authorities vested in me by “The Public Reserves Act, 1881,” aforesaid, declare my intention to change the specific purpose of the reserve described in the Schedule hereto from a public-hall site to a site for a Mechanics’ Institute and Library.


SCHEDULE.

ALL that parcel of land in the Wellington Land District, containing by admeasurement 1 rood, more or less, being Section No. 3, Block VI., Taihape Township.

As witness the hand of His Excellency the Governor, this thirty-first day of October, one thousand eight hundred and ninety-eight.

Notice of Intention to define the Purpose of a Reserve in the Township of Seddonville.

RANFURLY, Governor.

WHEREAS by the fifth section of “The Public Reserves Act, 1881,” it is amongst other things enacted that, in the case of any public reserve now vested in Her Majesty or the Governor, whether the same be granted or not, such reserves not being for one of the purposes comprised in Class I., if there shall, in the opinion of the Governor, be any doubt or uncertainty as to the purpose for which such reserve was set apart, the Governor may, by notice gazetted, define such purpose or purposes as to either the whole or any part of such reserve:

And whereas the land described in the Schedule hereto was reserved on the eleventh day of March, one thousand eight hundred and ninety-six, for public buildings: And whereas it is expedient to define the specific purpose for which such land shall hereafter be set apart:

Now, therefore, I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby, in exercise and pursuance of the powers and authorities vested in me by “The Public Reserves Act, 1881,” aforesaid, declare my intention to define the specific purpose of the reserve described in the Schedule hereto to be a site for the house of the Railway Stationmaster.


SCHEDULE.

ALL that parcel of land in the Nelson Land District, containing by admeasurement 1 rood 26 perches, more or less, being Section No. 130 of the Township of Seddonville.

As witness the hand of His Excellency the Governor, this eleventh day of October, one thousand eight hundred and ninety-eight.
