Powers delegated to the Ellesmere Domain Board under “The Public Domains Act, 1881.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fourth day of October, 1898.
Present:
His Excellency the Governor in Council.
IN exercise and pursuance of the powers and authorities vested in him by “The Public Domains Act, 1881,” His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council thereof, doth hereby revoke a certain Order in Council, dated the fourth day of June, one thousand eight hundred and ninety-five, making delegation of certain powers in manner as therein appears; and doth, with the like advice and consent, by this present Order, delegate, but only with respect to the piece or parcel of land described in the Schedule hereto, all the powers conferred by the Act aforesaid, except the powers under or conferred by sections five and twelve thereof, to the under-mentioned persons, who shall be known as the Ellesmere Public Domain Board, namely,—

LEWIS MATHIAS,
ARTHUR CHAMBERLAIN,
GEORGE MCCLURE, and
THOMAS DEWAR BOAG
(hereinafter referred to as “the Board”), subject to the stipulations hereinafter contained, that is to say,—

The Board shall meet for the transaction of business on the first Monday in each month, at half-past four o’clock p.m., at the office of the Chairman, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Monday, the seventh day of November, one thousand eight hundred and ninety-eight.

Special meetings may be convened by the Chairman or by any two members of the Board, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

Any three of the said Board shall form a quorum. Any meeting may be adjourned from time to time.

The members of the Board shall, at their first meeting, and thereafter at an annual meeting to be held on the first Monday in February in every succeeding year thereafter, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose some one of their number to be chairman of such meeting.

If, by resignation, death, or incapacity, or otherwise, the office of Chairman shall be or become vacant, the members may at any monthly or special meeting appoint a Chairman.

All questions shall be determined by the majority of votes of the members of the Board present at a meeting.
SCHEDULE.
All that parcel of land in the Ellesmere District, in the Canterbury Land District, containing by admeasurement 213 acres, more or less, being Reserve No. 1630. Bounded towards the north-west by a road-line for a distance of about 52 chains 50 links; towards the north-east by Sections Nos. 14510 and 15026 for distances respectively of 23 chains 55 links and 40 chains; towards the south by Section No. 6730 for a distance of 36 chains 54 links; towards the south-east by a road-line for a distance of about 18 chains 50 links, and also by Section No. 15026 for a distance of 6 chains 4 links; towards the west by another road-line for a distance of about 21 chains 50 links: save and excepting Reserve No. 964, situate in the above-described section: as the same is delineated on the plans deposited in the District Survey Office, Christchurch.

Lyttelton Harbour Board to be subject to the Provisions of “The Public Bodies’ Powers Act, 1887.”

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fourth day of October, 1898.

His Excellency the Governor in Council.
WHEREAS by section four of “The Public Bodies’ Powers Act, 1887” (hereinafter termed “the said Act”), it is provided that the Governor, by Order in Council, may from time to time declare that any leasing authority shall be subject to the provisions of the said Act, but that no such Order shall have any effect unless it be issued at the request or upon the recommendation of the leasing authority on whose behalf such Order is issued:
And whereas it has been made to appear that the Lyttelton Harbour Board are a leasing authority within the meaning of the said Act, and have requested that they may be brought under the provisions thereof:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, and in pursuance and exercise of the powers and authorities conferred upon him by the said Act, doth hereby order and declare that from and after the date hereof the Lyttelton Harbour Board shall be subject to the provisions of “The Public Bodies’ Powers Act, 1887.”

Exchange of a Reserve in Auckland for other Land.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-fourth day of October, 1898.

WHEREAS the land mentioned in the first column of the Schedule hereto was reserved for plantation purposes: And whereas, in the opinion of the Governor, it is expedient to exchange the said land for that described in the second column of the Schedule hereto:
Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” and the third section of “The Public Reserves Act Amendment Act, 1889,” doth hereby declare that, from and after the day of the date hereof, the said reserve described in the first column of the Schedule hereto may be exchanged for the land described in the second column of the Schedule hereto.
