Authorising Sale of Land to Korowhiti Tuataka under the Provisions of “The Native Land Purchases Act, 1892.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirteenth day of September, 1898.

Present:

His Excellency the Governor in Council.

WHEREAS by the nineteenth section of “The Native Land Purchases Act, 1892,” it is enacted that “the Governor may, by Order in Council, authorise the sale of any Crown land heretofore or hereafter acquired from Natives to any Native or Natives, at such price, and subject to such restrictions upon the further alienation thereof, as he may, by the same or any subsequent Order in Council, direct”: And whereas on the sale to the Crown of the Taumata No. 3B East Block, an agreement was entered into between Korowhiti Tuataka, one of the Native owners thereof, and the Honourable A. J. Cadman, the then Minister for Native Affairs, for the sale to the said Korowhiti Tuataka of the land more particularly described and mentioned in the Schedule hereto, and forming portion of the Taumata No. 3 West Block, so acquired from Natives as aforesaid: And whereas it is expedient to authorise the sale to the said Korowhiti Tuataka of the piece of land above referred to:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance of the powers and authorities conferred by the nineteenth section of “The Native Land Purchases Act, 1892,” and by and with the advice and consent of the Executive Council of the said colony, doth hereby authorise the sale, for the sum of twelve pounds nineteen shillings, to the said Korowhiti Tuataka, of the land described in the Schedule hereto.

SCHEDULE.

ALL that parcel of land in the Land District of Auckland, being Section No. 7 of Block XV., Otanewainuku Survey District, containing by admeasurement 60 acres, more or less. Bounded towards the north by Section No. 9, 3688 links; towards the east by the main road from Tauranga and Oropi to Rotorua, 761·3 links, 787 links, and 575·3 links; towards the south and west by Section No. 6, 2429 421·7, 238, 195·7, 233, 279, 173·7, 286·2, 267, 217, 257·4 links respectively; and towards the north-west by the Taumata No. 3B West No. 2 Block, 567 links: be all the aforesaid linkages more or less: as the same is more particularly delineated on the plan deposited in the Lands and Survey Office, Auckland.

“The Arms Act, 1880.”—Fee of £1 for Dealer’s License reimposed in North Island.

ORDER IN COUNCIL.

At the Government House, at Wellington, this thirteenth day of September, 1898.

His Excellency the Governor in Council.

IN pursuance and exercise of the power and authority vested in him by “The Arms Act, 1880,” and of all other powers and authorities in this behalf enabling him, His Excellency the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke that portion of a certain Order in Council made and issued under the said Act on the twenty-fifth day of August, one thousand eight hundred and eighty-five, and now in force, which provides that from and after the date therein mentioned “the fee of one pound payable in respect of a dealer’s license in the Form B in the First Schedule to the said Act shall no longer be chargeable”; and in further pursuance and exercise of the powers and authorities aforesaid, and with the like advice and consent as aforesaid, his said Excellency doth hereby order and declare that from and after the day on which this Order shall be in force the fee to be paid to a licensing officer under the said Act for a dealer’s license in the Form B in the First Schedule thereto, in the district contained within the North Island of New Zealand and the adjacent smaller islands, shall be one pound; and also doth hereby vary and alter the fees prescribed by the Second Schedule to the said Act for a dealer’s license in the Form B accordingly; and, lastly, in pursuance and exercise of the powers and authorities aforesaid, and with the like advice and consent as aforesaid, doth hereby declare that this Order shall be in force in the district hereinbefore mentioned from and after the first day of November now next ensuing.

Notifying Lands in Taranaki for Sale by Public Auction.

RANFURLY, Governor.

IN pursuance of the powers and authorities conferred upon me by the one-hundred-and-thirteenth section of “The Land Act, 1892,” I, Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, do hereby appoint Friday, the twenty-eighth day of October, one thousand eight hundred and ninety-eight, as the time at which the lands enumerated in the Schedule hereto shall be sold by public auction; and I do hereby fix the prices at which the said lands shall be sold as those mentioned in the said Schedule hereto.

Section 42 is weighted with £45, valuation for improvements, there being a small four-roomed house on it.

The Huiakama Village is situate on the Ohura Road, a short distance from the Township of Strathmore, and about twenty-one miles and a half from Stratford Railway-station. Sections 32, 33, 34, and 35 are all in bush, the remainder are felled and grassed land, the small sections having a fall towards Mangaotuku Stream. The general character of the soil is good. It is proposed to erect a creamery on Section 32, which will be protected by valuation for improvements.

Removal of Restrictions on Alienation of Native Land.

RANFURLY, Governor.

WHEREAS application has been made to the Governor by the Native owner of the land described in the Schedule hereto, praying that the restrictions on the alienation of such land contained in Crown grant dated the second day of February, one thousand eight hundred and eighty-five, may be removed: And whereas inquiry has been duly made by the Native Land Court, and the said Court has recommended that such restrictions be removed:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the powers conferred on him by the fifty-second section of “The Native Land Court Act, 1894,” and in accordance with the recommendation of the Native Land Court, doth hereby order and declare that the restrictions imposed by the said Crown grant on the alienation of the said land are hereby removed.

SCHEDULE.

ALL that parcel of land, situate in the Provincial District of Taranaki, containing 50 acres, more or less, being Section No. 98, Block VII., Waitara Survey District, held under Crown grant dated 2nd February, 1885, in favour of Te Rakatau, and containing the following restrictions: “Inalienable by sale, or by lease for a longer period than twenty-one years, or by mortgage, except with the consent of the Governor being previously obtained to every such sale, lease, or mortgage.”

As witness the hand of His Excellency the Governor, this twelfth day of September, one thousand eight hundred and ninety-eight.
